Ramadan: Makinde calls for increased prayers, good neighbourliness

    By Adewale Owoade

Gov. Seyi Makinde of Oyo State has congratulated the Muslim Ummah in the state and across the world on the commencement of the month of Ramadan 1445.

Makinde, who described the holy month as a blessed month in which Allah rewards the worship of the Muslim Ummah, charged Muslims to increase their prayers for the country and the state.

Governor Makinde called for increased prayers for the country amid the economic hardship facing the people, noting that though leaders have been doing everything to turn the situation around, prayers are of greater essence at this time.

He equally charged Muslims around the world to demonstrate the lessons of love, kindness and good neighbourliness as taught by Prophet Mohammed, admonishing those who have enough to remember their neighbours, as more people are going through hard times.

According to the governor, his administration had been doing everything possible to mitigate the effects of the economic hardship and it will not relent until life becomes better for all residents of the state.

He said: “I felicitate my Muslim brothers and sisters on the occasion of the commencement of the month of Ramadan 1445.

“This is another opportunity offered to us by Allah (SWT) to serve Him and seek His face and I will encourage all and sundry to make good use of the opportunity as always.

“I charge the Muslim Ummah to, as they have always done, pray for our dear State and Nigeria, as we have all come to realise that prayer remains the greatest key for believers to make things happen.

“We do know that our country is in a bit of economic hardship, but while we continue to look up to the leaders to do the needful, we must also support our hopes with prayers to God.

“I also want to charge my Muslim brothers and sisters, especially those who have in abundance, to remember their neighbours and show kindness.

“It is my prayer that Allah SWT will reward your acts of worship and accept it as Ibadah.”

NÀFDAC Vows to Tackle Diversion of Medical Narcotics to Illicit Use

As Provost, Medical School Laments Doctors, Other Professionals addiction To Illicit Drugs

    By Biola Lawal
Flowerbudnews:  The Director General, National Agency for Food and Drug Administration and Control (NAFDAC) Prof Mojisola Adeyeye has vowed to further strengthen NÀFDAC mechanism for prevention of diversion of narcotics meant for medical and scientific purposes to illicit use.

Prof Adeyeye gave the assurance at launch of the International Narcotics Control Board (INCB) annual report availability supplement and precursor report 2023 by NAFDAC in Lagos on Thursday, Sayo Akintola NÀFDAC Resident Media Consultant disclosed in a statement.

The NÀFDAC Boss reiterated the Agency’s commitment to ensuring the availability of narcotics and controlled substances for medical and scientific purposes while preventing diversion to illicit use in Nigeria.

Prof Adeyeye’s assurance was against the , backdrop of the outcry by the Provost of the Medical School, University of Lagos, Prof Adewale Anthonio Oke that some surgeons and other medical professionals involved in the surgical operation of patients tended to be addicted to narcotic drugs used as painkillers for patients after surgery.

Prof Adeyeye however, noted that narcotics and psychotropic substances were indispensable in the management of pains and other medical conditions.

The NÀFDAC Boss noted that ”there is a need to balance the access and control of these substances due to the addictive potential of many of them,”

She stressed that INCB reports the world drug situation yearly to inform governments of countries that were party to the International Conventions on drug control efforts.

According to her, ”the annual report for the year 2023 has a special focus on the role of the Internet, including social media, in drug trafficking and use. It explores the challenges and opportunities for drug control, prevention, and treatment, in the era of the Internet, with a specific look at the evolving landscape of online drug trafficking.”

The NAFDAC boss who was represented by the Director, Laboratory Services (Food), Dr Charles Nwachukwu, however, stressed that Competent National Authorities must scale up their activities, and monitor online advertisement and sales of controlled substances to stay ahead of traffickers.

The report further analyses the global availability of narcotic drugs and psychotropic substances for medical and scientific purposes. It highlights the persistent disparities in access to medicines for the treatment of pain.

The precursors report x-rays issues related to trafficking in synthetic drugs including non-medical synthetic opioids, cocaine and their precursors which represent a growing threat to public health.

The DG reiterated some of the measures already put in place by NAFDAC to ensure availability and prevent the diversion of controlled medicines to illegal use.

E -permit issuance The Agency has commenced the issuance of an electronic permit to import controlled substances since 2017 with the intention to link this process to the international Import and Export Authorization system (I2ES)

Pre-Export Notification (PEN) Online System- This platform has been of great utility in monitoring international trade in controlled medicines and precursor chemicals. Its use is to confirm the legitimacy of transactions of proposed imports.

Monitoring the integrity of the distribution chain- The Agency is scaling up its monitoring and surveillance of the distribution chain by verification of sales, documentation review and increasing the frequency of warehouse and facility inspection.

National Drug Control Master Plan (NDCMP) – This is a multi-agency, multi-sectoral strategic planning and implementation framework that covers key aspects of drug supply and reduction impacting Nigeria. It is aimed at strengthening responses to drugs to contribute to the enhanced health, security and well-being of all Nigerians.

National Pharmaceutical Traceability- NAFDACs traceability implementation strategy is in line with the Nigeria National Traceability Strategy Policy document published by the Federal Ministry of Health in May 2020.

The implementation started with controlled substances in January 2024. Other pharmaceutical products will be added in due course.

Global Rapid Interdiction of Dangerous Substances (GRIDS)- INCB Regional Technical Officer for Central and West Africa has been selecting focal points for multi-agency training courses on real-time communication and intelligence sharing tools (IONICS and GRIDS intelligence) and awareness raising and safe handling of dangerous substances in the region.

This aims to support law enforcement and regulatory agencies to identify and dismantle criminal organisations through the identification of modus operandi, risk profiling operations, and the exchange of information for launching and supporting investigations and enforcement operations against the trafficking of new psychoactive substances (NPS), non-medical synthetic opioids, and other dangerous substances.

Drug Demand Reduction Activities- the Agency carry out education and awareness campaigns in schools, workplaces, religion organizations, marketplaces etc. and collaborate with National Drug Law Enforcement Agency (NDLEA) NGOs and other relevant organization to create drug abuse sensitization across the country.

She, however, acknowledged the collaborative efforts and cooperation of sister agencies like the Nigeria Customs Service, National Drug Law Enforcement Agency (NDLEA), and The Nigeria Police, who have all been of tremendous help to the agency.

Speaking in the same vein, Provost of the Medical School, University of Lagos, Prof. David Adewale Anthonio Oke, underscored the aptness of the occasion, given the fact that in clinical practices, several drugs and derivatives of narcotics, particularly opium and their derivatives are used in pain management, most especially in some critical conditions that involve excruciating pains.

Prof Oke, who was represented by Prof Olatunji Aina, a professor of Psychiatry at the College of Medicine disclosed that not only the members of the public indulge in abuse of medical narcotics.

He lamented that doctors and other professionals that have these drugs in custody at the hospitals overtime tend to be addicted to the drugs they administer to the patients.

Even amongst our colleagues in the health practice, especially those that work in the theater including professionals that are directly in charge of these drugs, some of them overtime tend to be addicted to the drugs., he said, describing it as a big public health problem that only a collaboration between NAFDAC and NDLEA could nip in the bud.

He explained that some medical conditions like sickle cell disease crisis, orthopedic cases, particularly fracture cases and in the management of cancer, would warrant giving some of these narcotics to the patients to relieve them of severe pain.

He averred that severe pain is one of the symptoms in most cases of cancer when the tumor is exerting pressure on a certain part of the body, adding that in post-surgery, quite a number of these drugs are used in management of pain after surgery.

According to him, the dilemma of the physician is when the patient now becomes addicted, stressing that it is very important to know at what point a patient no longer requires analgesics and has become addicted.

In some cases, he said sometimes when you think the clinical situation has improved and would not warrant demand for analgesics, such patient still demands for the drugs.

Im very happy about the control of these medicines by NAFDAC because its one of the commonest problems we have in psychiatry, particularly patients that are addicted to the controlled medicines and injections, he said. (Flowerbudnews)

Court varies suspended UNICAL professor’s bail, accepts Ndoma-Egba, Efut as sureties

    Flowerbudnews

A Federal High Court, Abuja, on Wednesday, accepted Sen. Victor Ndoma-Egba as surety for the bail earlier granted Prof. Cyril Ndifon, the suspended Dean of Faculty of Law, University of Calabar (UNICAL).

Justice James Omotosho, in a ruling, also accepted Mr Okon Efut, SAN, as Ndifon’s second surety in the four-count charge preferred against him and his lawyer, Mr Sunny Anyanwu, by the Independent Corrupt Practices and Other Related Offences Commission (ICPC).

The News Agency of Nigeria (NAN) reports that Ndoma-Egba, a three-time senator, represented Cross River Central Senatorial District in the National Assembly.

NAN reports that Justice Omotosho had, on Feb. 9, admitted Ndifon to bail in the sum of N250 million with two sureties in the like sum.

The judge held that the two sureties, who must be owners of landed property in the FCT with registered titles and a minimum valuation of N150 million, must submit their certified bank statements to the registrar of the court.

He also directed Ndifon to submit his international passport to the court registrar.

The judge ordered the suspended dean to sign an undertaking not to interfere with the case, be ready to stand his trial and not delay the trial.

Ndifon, through his counsel, Mr Joe Agi, SAN, had, on Feb. 27, applied that the bail conditions earlier granted him be varied because he was unable to meet the terms set by the judge.

In the motion filed, Agi sought an order varying Ndifon’s bail terms.

He also sought an order granting the application that Ndoma-Egba and Efut be admitted as his sureties.

The lawyer prayed the court to exercise its discretion in favour of his client by releasing him to the intending sureties based on recognition.

Delivering the ruling, Justice Omotosho held that since the charges against Ndifon were not capital offences, the court was inclined to exercise the discretion in his favour.

He said bail is a constitutional right guarantees for any person facing criminal charge.

The judge, who admitted Ndifon to the sum N250 million bail, directed that the two sureties shall be Ndoma-Egba and Efut as suggested by the don.

He ordered Ndifon to deposit his international passport with the court registry and shall not be renewed until the leave of court is granted.

Justice Omotosho equally ordered the suspended professor and the two sureties to submit their bank statements to the court.

The judge, who said that the two sureties shall have landed property within the Abuja Municipal Area, adjourned the matter until March 12 for Ndifon and his co-defendant, Anyanwu, to enter their defence.

NAN reports that Ndifon was, on Jan. 25, re-arraigned alongside Anyanwu on an amended charge bordering on alleged sexual harassment and attempt to perverse the cause of justice.(NAN)(www.nannews.ng)

  • CJN, others ask court to dismiss suit challenging appointment of 12 judges

CJN, others ask court to dismiss suit challenging appointment of 12 judges

    Flowerbudnews

The Chief Justice of Nigeria (CJN), Justice Olukayode Ariwoola, and others, on Thursday, prayed a Federal High Court (FHC), Abuja to dismiss a suit filed by a lawyer, Azubuike Oko, seeking to stop the appointment of 12 judges into the FCT High Court.

Akinlolu Kehinde, SAN, who appeared for Ariwoola, the Chief Judge (CJ) of FCT, Hussein Baba-Yusuf, and National Judicial Council (NJC), told Justice Inyang Ekwo while adopting their processes and presenting their argument against the suit.

In a preliminary objection dated and filed March 1 by the senior lawyer, Kehinde urged the court to strike out or dismiss the suit marked: FHC/ABJ/CS/205/3024 for want of jurisdiction.

The counsel, who gave four-ground of arguments, said under Section 6(6)(c) of the 1999 Constitution (as amended), Section 14(3) of the 1999 Constitution is non-justiciable.

He argued that Oko, the plaintiff, lacked the locus standi to institute the action.

“Under Section 245C(1)(a) of the 1999 Constitution (as amended), the National Industrial Court of Nigeria has exclusive jurisdiction to determine matters relating to or connected with the employment of judicial officers.

“Under Section 245C(1)(d) of the 1999 Constitution (as amended), the National Industrial Court of Nigeria has exclusive jurisdiction to determine matters relating to or connected with and any dispute over the interpretation and application of Section 42 of the 1999 Constitution as it relates to the employment of judicial officers,” Kehinde argued.

In the affidavit in support of the preliminary objection deposed to by Kemi Esene, a litigation secretary in the law firm of Kehinde and Partners, she told Justice Ekwo that on Sept. 30, 2020, the honourable court dismissed a similar suit.

She said the sult, marked: FC/ABJCS/602/2020 filed by JRP Foundation Ltd against the former President Muhammadu Buhari and 24 others, was dismissed on June 10, 2020.

Esene said the sult had challenged the recommendation of 21 persons by the NJC to Buhari for appointment as judges of the High Court of the FCT.

She said the plaintiff had alleged that the Judicial Service Committee of the FCT acted In bad faith and grossly abused the power vested in it when it submitted the list of nominees for appointment as judges of the FCT High Court to NJC.

The lawyer averred that the court, in its judgment, upheld the preliminary objection of the defendants and said that since the plaintiff was not a party to the procedure for the appointment of the judicial officers, the foundation had no locus to institute the action.

Besides, she said the court held that FHC had no jurisdiction over the matter because the subject matter had to do with employment of the persons recommended by NJC to be appointed as judges by the former president.

When the case was called on Thursday, plaintiff’s lawyer, Nkemakolam Okoro, told the court that the matter was adjourned for hearing and that they were ready to proceed.

Okoro said he filed an originating summons dated and filed Feb. 16.

He said upon receipt of the counter affidavit jointly filed by FCT CJ, NJC and CJN, he filed a response on March 4.

He said he equally filed a counter affidavit on March 4 to oppose their preliminary objection.

Okoro urged the court to grant their reliefs.

Akinola Fasanmi, who appeared for appeared for the Nigeria’s president and the Attorney-General of the Federation (AGF), adopted all the processes filed by Kehinde.

Justice Ekwo adjourned the suit until March 15 for judgment.

The News Agency of Nigeria (NAN) reports that the judge had, on Feb. 23, rejected Oko’s ex-parte motion seeking to stop Baba-Yusuf from appointing 12 judges into the bench of the court.

Justice Ekwo, in a ruling on the ex-parte motion moved by Emmanuel Emerenini, rather directed the plaintiff to put the defendants on notice of the motion ex-parte within 2 days of the order.

Justice Ekwo also ordered Oko, a legal practitioner, to serve the defendants with all processes filed in the suit within two days of the order for the defendants to show cause why the prayers on the motion ought not to be granted in the next adjourned date.

He, however, made an order for accelerated hearing.

Oko, in the motion, had sued Baba-Yusuf, NJC and Federal Judicial Service Commission (FJSC) as 1st to 3rd defendants.

Also joined in the suit are the CJN, President of Nigeria and AGF as 4th to 6th defendants respectively.

The plaintiff sought an order directing the parties in the suit to maintain status quo ante bellum pending the hearing and determination of his motion on notice.

Oko said he hails from Ebonyi, which had been routinely excluded and marginalised with respect to the appointment of judges of the High Court of FCT by Baba-Yusuf, NJC and FJSC.

The lawyer averred that, as a matter of fact, it was the CJ (Baba-Yusuf) that computes the names of qualified lawyers from selected states of the federation and transmitted to FJSC for recommendation to NJC for appointment by the President of Nigeria,as judges of the FCT High Court.

He averred that the states mentioned for nomination of lawyers for appointment as judges into the 12 positions were Bauchi, Bayelsa, Enugu, Imo, Kogi, Kwara, Lagos, Oyo, Plateau, Rivers, Taraba, and Zamfara.

He, however, alleged that currently, Oyo and Kogji “already had two serving judges in the FCT High Court, and the two states were given additional slots, to now have three judges, despite the fact that Ebonyi State has no single serving judge in the High Court of the FCT.”

He prayed the court to grant their motion in the interest of justice.(NAN)(www.nannews.ng)
