    Drama in court as lawyer tackles judge for adjourning suspended UNICAL professor’s bail plea

     

     

    Abuja: There was a mild drama at a Federal High Court, Abuja, on Friday, after Justice James Omotosho adjourned the hearing of a bail application of Prof. Cyril Ndifon, the suspended Dean of Faculty of Law, University of Calabar (UNICAL), until Jan. 31.

    The adjournment followed counsel for the prosecution, Osuobeni Akponimisingha’s objection that he was just being served with Ndifon’s further affidavit and would need time to study the process in the interest of fair hearing.

    The development did not go down well with Solomon Umoh, SAN, who appeared for Ndifon and Sunny Anyanwu, the co-defendant.

    The News Agency of Nigeria (NAN) reports that the Independent Corrupt Practices and Other Related Offences Commission (ICPC) is prosecuting Ndifon and Anyanwu (1st and 2nd defendants) on allegations bordering on sexual harassment and threatening the star witness in the case.

    Anyanwu, who is one of the lawyers in the defence, was joined in the amended charge filed on Jan. 22 by the ICPC on allegation that he called one of the prosecution witnesses on her mobile telephone during the pendency of the charge against Ndifon to threatened her.
    Justice Omotosho had, on Thursday, ordered the two defendants to be remanded in Kuje Correctional Centre pending the hearing of their bail applications.
    The judge, who adjourned the matter until today (Friday), held that the bail request would be taken after the trial.
    When the matter was called on Friday for continuation of trial, Umoh prayed the court to allow the hearing of his clients’ bail applications before the trial but Akponimisingha opposed it, saying based on the previous day’s directive of the court, the trial should be taken first.

    The ICPC lawyer argued further that he was just being served with the latest application filed on Thursday by Umoh and that he would need time to study it whether to respond or not.
    But Umoh told the court that Akponimisingha was being economical with the truth because he was aware of the medical report attached to the application already, and that the instant application was just an adjunct.

    He said when the judge admitted Ndifon to temporary bail on Jan. 10 to enable him go for a glaucoma surgery slated for Jan. 11, it took them about a week to perfect the bail before the professor could proceed.
    He said the latest documents attached to the bail application had been verified by the ICPC in Exhibit PF

    “So why will the counsel seek for an adjournment?” he asked.
    Besides, Umoh argued that Akponimisingha had no right to file any other process after the one he filed “because this is the final process.”
    He insisted that bail is a constitutional right which should not be taken away from his clients, even though they had been subjected to media trial.
    “We are talking of a constitutional right of a professor of Law to liberty,” he said.
    The senior lawyer urged the court to overrule Akponimisingha and proceed to hear the bail plea.
    Umoh said in the event that his application was not granted, “we ask that the interim bail be extended because he (Ndifon) has an imminent irreversible eye defect.”
    But the anti-graft commission’s lawyer disagreed with Umoh.

    He argued that the exhibit (Exhibit PF3) that the learner silk cited that they verified was in response to the medical report dated Dec. 29, 2023, and not the one dated Jan. 19.
    He said contrary to Umoh’s claim, the commission had not verified the latest exhibit (Exhibit A).

    “We have not verified the instant exhibit dated 19th day of January, 2024. He just serves me about three minutes ago.
    “I am just seeing this document for the first time. Fair hearing demands that I be allowed to see it whether to respond to it or not.
    “That is my reserved right which cannot be taken away from me. That is why I sought an adjournment to enable me look into it,” he said.
    Ruling, Justice Omotosho said in view of the fact that the further affidavit filed on Jan. 25 by Umoh was served on Akponimisingha in the courtroom, “it is fair hearing that the lawyer be given time to respond.”
    He said since accelerated hearing had been granted in the matter, the court would give a short adjournment.
    The judge consequently adjourned the matter until Jan. 31 for hearing of the bail applications.
    But shortly after the adjournment, Umoh stood up to address the court.
    The senior lawyer, who insisted that bail is a constitutional matter, said the application he brought was in line with the constitution.
    He reminded that Ndifon did not flout the interim bail granted by the court, hence the need to admit him to bail or extend the earlier one granted him.
    “I beg in the name of God that he should be granted the bail in the terms granted him earlier,” he said.
    Responding, Justice Omotosho said the earlier bail granted was granted on the premise that there were facts before the court that Ndifon was going for a medical surgery on a scheduled date.
    He said even though they were unable to conclude on the bail application, the defendant was allowed to go on bail but did not undergo the surgery in the long run.
    He said the facts about the present application were not before the court.
    “You filed a process on Jan. 25 and you served the prosecution counsel today.
    “That process has a medical report that was not before the court and the prosecution said he needs to respond
    “I have looked at my diary and there are many cases on Monday and Tuesday.
    “Even on Wednesday, Jan. 31, I have about 19 cases but I conceded to ensure that the bail application is taken,” the judge explained politely.
    Umoh then prayed the court to take Anyanwu’s bail, saying “the bail of the 2nd defendant is independent of the 1st defendant. I will always thank you.”
    Umoh consistently addressed the court using the word, “You,” and the judge corrected him, saying “learner silk, you are 13 years as senior advocate. You don’t address the court using ‘you’.”
    “Don’t judge me with this because I am on my weakest point today,” Umoh responded.(NAN)(www.nannews.ng)

    Enugu: Joint troops have cleared several camps of the Indigenous People of Biafra (IPOB) and it’s Eastern Security Network (ESN) along Umulolo-Umukele- Amousu and Agbobu in Okigwe Local Government Area of Imo.

     

    The joint troops are made-up of troops of the 82 Division of the Nigerian Army, Navy and Air Force in conjunction with the Nigerian Police and Nigerian Security and Civil Defence Corps.

    Lt.-Col. Jonah Unuakhalu, Acting Deputy Director, 82 Division Army Public Relations, said in a statement on Friday that the troops stormed and destroyed hideouts of the terrorist despite encountering several Improvised Explosive Devices (IED).

     

    Unuakhalu said that the troops also cordoned-off and searched several buildings used by the terrorist.

    According to him, during the search, signs of the terrorist’s activities, occultic and acts of cannibalism by the group were discovered.

     

    He said: “The troops also destroyed the IED making factory of the terrorist.

     

    “The troops recovered rank badges of two policemen that were kidnapped along Enugu-Port Harcourt Road.

    “Other items discovered include Biafran currencies, fake US Dollar bills, Biafran Liberation Army T-shirts, and other Biafran insignia.

     

    “Military kit bags, cables used for IED detonation and axes.

    “Two suspects were arrested and also burnt policemen corpses were discovered for proper burial.”

     

    In another development in Owerri metropolis in Imo, troops on night patrol thwarted a kidnapping attempt by some suspected IPOB/ESN terrorists.

     

    The army spokesman said that the troops engaged the criminals in a gun duel forcing them to abandon the victim.

    He said that troops recovered one AK 47 rifle and magazine, a G-3 rifle with mounted magazines and the vehicle used by terrorists.

     

    Unuakhalu said: “Furthermore, in a bid to strengthen cordial civil-military relations and create a peaceful society, the General Officer Commanding (GOC) 82 Division of Nigerian Army, Maj.-Gen. Hassan Dada, visited Isiuzo-Amufu community in Enugu State on Jan. 24, 2024.

     

    “The GOC, who addressed the people of Isiuzo-Amufu community at their village square, advised the community on the need to cooperate and assist the military to put an end to the insecurity of the community and the region at large.

     

    “He assured the people of his commitment to end the herders and farmers clash and youth restiveness within the region.

     

    “He met with other security agencies in the council area and enjoined them not to relent on the ongoing collaborative efforts and synergy of information gathering and sharing with the military for improved security within the community and South-East.”

     

    Unuakhalu said that the GOC appreciated the incredible cooperation of other security agencies for the success achieved so far.

     

    “The GOC wishes to enjoin the good people of the South-East to support and continually provide timely, reliable and credible information through the Emergency Line ‘193’ by pressing 2.

     

    “The Nigerian Army will continue to protect lives and property of the good people of the South-East as it carries out its constitutional roles within the ambit of the law,” he added.

    Ghana coup plot: Soldiers among six sentenced to death by hanging

    Six Ghanaians, including three soldiers, have been sentenced to death by hanging for their involvement in a coup plot three years ago.

     

    This was the first treason trial in Ghana since 1966 when post-independence leader Kwame Nkrumah was overthrown.

     

    The six were arrested in 2021 while testing weapons in the capital, Accra, to allegedly topple the government.

     

    The group, including a gunsmith, pleaded not guilty during a trial that captured the attention of the nation.

     

    Three other people, including a senior police officer and two military officers, were acquitted.

     

    There was a heavy security deployment outside the High Court in Accra during the sentencing on Wednesday.

     

    The court found the six guilty of high treason and conspiracy to commit high treason.

     

    The men were arrested with locally manufactured guns, improvised explosive devices and AK-47 rifles, according to court documents.

     

    State prosecutors said the group had planned to organise protests, ostensibly to topple President Nana Akufo-Addo’s government ahead of the 2020 general elections.

     

    The court said it found the evidence against the men, including intercepted communications and testimonies, compelling.

     

    Attorney General Godfred Yeboah Dame, who led the prosecution, praised the court verdict as “significant”.

     

    “The constitution of Ghana as the fundamental law of the country, which has sustained the stability of the nation, frowns seriously upon any attempt to overthrow a government and that is why that offence [treason] is punishable by death,” Mr Dame said.

     

    Ghana had last carried out an execution in 1992 when it returned to democratic rule.

     

    Last year lawmakers last year voted to abolish the death penalty for ordinary crimes, replacing it with a life sentence.

     

    Defence lawyers said they would appeal against the ruling in the Supreme Court.

    The National Agency for Food and Drug Administration and Control (NAFDAC) says it has rolled out strategies to help Micro Small and Medium Enterprises (MSMEs) survive the temporary economic fallouts from fuel subsidy removal.

     

    This was contained in a statement signed by the Director-General of the agency, Mojisola Adeyeye, and issued to journalists on Monday in Abuja by Olusayo Akintola, NAFDAC media consultant.

     

    Mrs Adeyeye, a professor, disclosed that the new set of strategies was targeted to help MSMEs survive the economic situation from the fuel subsidy removal, to enhance the ease of doing business in Nigeria.

     

    Mrs Adeyeye said the agency had reviewed downward, the present administrative charges for late renewal of NAFDAC-regulated products to make the business environment more investment-friendly in a quick response to the realities of the time.

     

    This translates to a 65 per cent decrease in processing fees for the renewal of registration for locally manufactured products (which will be N44,200).

     

    This is against what is currently charged and 45 per cent of the processing fee for foreign products (which will be $ 450) as against what is currently charged.

    the agency has also granted a 10 per cent review of tariff structure for facility and inspection fees for Special Economic Zones (SEZs) as businesses across the world confront the disruptions caused by the global economic meltdown.

     

    “NAFDAC will continue to adopt and implement practical measures to ensure that the projected growth in the MSMEs sector is not seriously affected by the development,” she stated.

     

    The NAFDAC boss further explained that the response of the agency was not just “to give succour and assistance to existing MSMEs, but also ensure that there is practical and active fillip to new MSMEs.

     

    This will ensure that the growth of the sector is not discouraged by the current economic trauma.

     

    She said it was the right moment for the agency and that NAFDAC, as a regulatory body, was prepared to back MSMEs and other businesses that were ready for the innovative and interesting times ahead.

     

    ‘’We have no excuse not to be one of the most productive and prolific economies in the world. We hope to achieve this aim in the incredible numbers of MSMEs that we have,” she said.

     

    The DG described NAFDAC palliatives for MSMEs as a thoughtful and strategic response to the realities of the present time, adding that those were indicators of the new spirit of NAFDAC and foretaste of the support for MSMEs in the trying times.

     

    According to her, this is not a new undertaking for the agency; it is merely an extension or intensification of the Federal Government’s long-standing commitment to MSMEs

    Gov. Ademola Adeleke of Osun State has called for closer developmental cooperation among South-west states.

     

     

    Gov. Adeleke stated this when he joined his Oyo State counterpart, Seyi Makinde to commission the 8.2 kilometres dualised Agodi Gate-Old Ife Road-Alakia-Adegbayi Junction Road, including the Onipepeye Underpass Bridge.

     

     

    Adeleke, who was the special guest of honour at the event, lauded the project as part of Governor Makinde administration’s infrastructure revolution, describing it as a great motivation for his colleagues in the South-West states.

     

     

    He also described Makinde as a golden governor in the areas of innovations and infrastructure development, even as he called for a collective and collaborative development in the region.

     

    “Oyo State governor’s performance is a great motivation not only for Osun but for other states in the South-West.

     

     

    “I am delighted to be present at this all-important event, which is one in the series of achievements recorded by my own brother, the governor of Oyo State.

     

    “In the whole of Western region, he is reputed to be the leading son in the areas of innovations, infrastructure and good governance.

     

     

    “We have lost that rating for some time now. But I want to put it on record that the South-West has regained the momentum.

    “As we continue to attract large, medium and small businesses into Oyo State, the pressure on our infrastructure increases and there is a need to upgrade them.

     

     

    “This is why we have chosen to keep investing in our infrastructure. Our goal is to upgrade cities and towns in Oyo State to places we can all be proud of.

     

     

    “As we all know, our wants and needs are infinite but the resources to meet them are limited, so, we often have priorities on the project that will bring the best value to the good people of the state.

    Earlier, the Commissioner for Public Works and Transport, Prof. Dahud Sangodoyin said the state government embarked on the project due to the expansion of Ibadan.

     

     

    He said that the road, which used to be a single carriage, was awarded to Messrs Kopek Construction Limited in October 2022 and that with the completion of the project, the Makinde administration has completed 187.42 kilometres of road under Omituntun 1.0 and Omituntun 2.0.

     

     

    Also, in separate goodwill messages, former President-General of the Central Council of Ibadan Indigenes (CCII), Chief Adebayo Oyero; the Asiwaju Oloja of Oyo State, Chief (Mrs) Raimi and the Iba Oluyole,  Alhaji (Chief) Nureni Akanbi, thanked the governor for the infrastructural and uncommon developmental strides through various projects.

    Nigeria football legends Olusegun Odegbami and Garba Lawal have advised the Super Eagles to be extremely cautious, stay focused, be disciplined and have self-belief when they step onto the field against the Indomitable Lions in their Africa Cup of Nations’ Round of 16 encounter in Abidjan on Sunday.

    Both giants of the African game have made a rendez-vous at the Stade Félix Houphouët-Boigny, following the Lions’ late surge that ensured a 3-2 win over The Gambia in Bouake on Tuesday, and Nigeria’s earlier second-place finish in group A behind Equatorial Guinea.

    Odegbami, a member of Nigeria’s 1980 AFCON-winning squad and former captain of the team, who also played three times against Cameroon in 1975 (friendly game that Nigeria won 1-0), 1978 (All-Africa Games in Algiers that ended 0-0) and 1980 (friendly game that ended 0-0), said the present crop of Super Eagles can achieve victory the way they did against the Lions at the same stage in Egypt four years ago.
     
    He also urged the players to be extremely diligent and be very clinical with the opportunities that come their way.

    “We may say that Cameroon have not pulled up any trees at this tournament, but the way they turned the game around against The Gambia sends a message. They are not to be taken for granted. I watched their game against Guinea and it was a fight-to-finish. We have been creating a lot of opportunities in our games but this time, we have to be clinical.

    “Cameroon could prove to be a different proposition from the teams we have played against at this competition. Apart from the rivalry between our two countries, the present generation of Indomitable Lions have a point to prove. They want to be seen in the garbs of the likes of Rigobert Song Bahanang (who is their coach), Samuel Eto’o Fils, Patrick Mboma and Geremi Njitap, and going further back, the likes of Roger Milla, Theophile Abega, Gregoire Mbida and Francois Omam Biyick.”

     

    Lawal, nicknamed Chindo, played four times against the Lions in 1997 (LG Cup), 2000 (AFCON final), 2003 (LG Cup) and 2004 (AFCON quarter-final). He says that self-belief will go a long way in steering the Eagles past the Lions on Saturday.

     

    “They must go in there believing in themselves to do the job. Self-confidence is a good feeling when approaching a game like this. I see the Super Eagles getting past the Cameroonians if they believe in themselves and keep it tight at the back.”

    Nigeria and Cameroon have clashed at the Africa Cup of Nations seven times, with each team winning thrice and one game drawn. Cameroon won the Final matches of the 1984, 1988 and 2000 AFCON tournaments, while the Eagles won the bronze-medal match 2-1 in 1992, defeated then Cup holders Cameroon 2-1 in the 2004 quarter-finals and won 3-2 in the Round of 16 in Egypt four years ago. Both teams drew 1-1 in the group phase in 1988, Samuel Okwaraji scoring a scorcher after only two minutes in Rabat and Roger Milla equalizing with a header when the Andrew Uwe-led Nigerian defence thought they had kept him off-side.

     

    As the Eagles returned to training on Wednesday, after resting on Tuesday, the match venue is also getting ready to welcome the two teams. It was on the same turf where both teams battled out the 1984 AFCON final.

     

    On 18th March 1984, Président Félix Houphouët-Boigny had declared a public holiday to encourage football fans to troop to the stadium for the final, as public interest in the competition had waned following the group stage elimination of the Elephants. Nigeria got in front after 10 minutes when Muda Lawal toe-poked a deflected pull-out past Joseph Antoine-Bell.

    The Lions equalized just before half-time, Stephen Keshi unwittingly diverting the ball into his own net from a free-kick, and they seized the game by the throat in the second half, deploying the experience and exposure from playing three matches unbeaten at the 1982 FIFA World Cup finals in Spain.     Lagos (Flowerbudnews):  Justice  Deinde I. Dipeolu of the Federal High Court sitting in Ikoyi, Lagos has convicted and sentenced one Ohaguim Ifeayin Emmanuel to one year imprisonment for dating scam.

    He was however, given an option of N200,000 fine, a statement by Dele Oyewale, Head, EFCC Media  and Publicity disclosed.

    Emmanuel, a graduate of Computer Science from Chukwuemeka Odumegwu  University, Uli,  Anambra State , was arraigned by the Lagos Zonal  Command of the Economic and Financial Crimes Commission, EFCC, on January 19, 2024, on  two-count charges bordering on cybercrime.

    One of the counts reads: “ That you, Ohaguim Ifeayin Emmanuel,  sometime in October, 2023, in Lagos, within the jurisdiction of this Honourable Court, with intent to gain advantage for yourself, fraudulently impersonated one “Benjamin Valdez” by holding yourself out as such on your Google Account and you thereby committed an offence contrary to and punishable under Section 22(2) (b) of the Cybercrimes (Prohibition, Prevention, etc) Act, 2015.”

    He pleaded “guilty” to the  charges when they were read to him. Following his guilty plea,  prosecution counsel, A.S. Wara, called on Usman Ahmed, an operative of the EFCC, to  review the facts of the case .

    Usman told the court that the defendant was arrested sometime in October, 2023, following  credible intelligence  received by the Commission on the activities of some internet fraudsters operating in Fine County  Estate, Orchid Road, Lekki, Lagos State.

    According to him, an iPhone 13 Pro, iPhone XR, iPhone X and Mercedez Benz C300 were recovered from him at the point of arrest.

    “Upon his arrest, he was duly processed and the defendant volunteered his statements.  Investigations were conducted and forensic evidence were printed out from his phone.

    In his statement, he confessed he was into dating scam.  Wara further told the court that the defendant confessed to have benefited 950 USD and N3.2m from his involvement in the criminal activity.

    Wara ,therefore, sought to tender, in evidence, the defendant’s extrajudicial statements, some items recovered from him: iPhone 13 Pro, iPhone XR, iPhone X and forensic investigation documents print out.

    They were all admitted as exhibits by the court.

    Justice Dipeolu, consequently, convicted and sentenced him to one year imprisonment, with an option of fine of N200,000( Two Hundred Thousand Naira).

    The Judge also ordered that the mobile phones  and Mercedes Benz C300 recovered from him be forfeited to the Federal Government of Nigeria.(Flowerbudnews)

    Enugu: Maj.-Gen. Hassan Dada, the General Officer Commanding (GOC) of 82 Division of the Nigerian Army, says the Army remains in the fore-front of promoting nation’s rich and beautiful cultural heritage.

    Dada said this on Thursday at the West Africa Social Activities (WASA) of the 103 Battalion, Awkunanaw,
    Enugu held at the Battalion’s barrack.

    The GOC, represented by the Commander of 54 Signal Brigade, Brig.-Gen. Anthony Kubiangha, noted that WASA provided an opportunity to present the nation’s diverse cultural cuisines, attires, dance displays and other unique heritage of the great people of the country.

    “It is also a unique occasion for us as officers and soldiers to sit together and interact with our family members, which call of duty might not easily permit us.

    “It is also time to get our families to know each other one-on-one and look after each other wellbeing within the barrack or cantonment community and our civilian neighbours.

    “This event will also enhance understanding of our diverse cultural norms and practises as well as promote peace and geninue oneness,” he said.

    The GOC, however, tasked troops of the Battalion to remain focussed in their assigned duties and continue to keep the flag flying.

    Earlier, the Commanding Officer (Rear) of 103 Battalion, Awkunanaw,
    Maj. Opeyemi Abai, appreciated the Chief of Army Staff (COAS), Lt.-Gen. Taoreed Lagbaja and the GOC for making the WASA occasion possible.

    Abai also thanked the guest of honour, former Gov. Ifeanyi Ugwuanyi of Enugu State, as well as representatives of the commissioner of police, commandant of NSCDC and the State Director of the DSS for making it to the event.

    “WASA is an annual event to bring all members of the barrack communuty together as well as our friends in other security agencies, civilian friends and well-wishers to enjoy our local culture and cuisines.

    “The event is in line with the COAS philosophy and the need to relate well with other security agencies in a joint security environment,” he said.

    The event featured various cultural cuisines, attires and dance displays as well as tug-of-war and presentation of awards to deserving soldiers that performed exceptional well in 2023.

    -Says Nigeria Risks Losing Headship of OPEC’s Board of Governors in 2025 if Aduda is Not Retained

    Abuja (Flowerbudnews): Stakeholders within the civil society community have appealed to the Office of the Head of Civil Service of the Federation and the Presidency to retain Gabriel Tanimu Aduda as the Permanent Secretary, Ministry of Petroleum Resources.

    The Executive Director, National Civil Society Council of Nigeria, Amb. Blessing Akinlosotu, who made the appeal at a press conference in Abuja, noted that Aduda had built enough capacity to handle affairs of a mainstream and sensitive Ministry.

    Akinlosotu said;  “we appeal to the Head of Service and the Presidency to urgently reconsider the redeployment, and retain Amb Gabriel Tanimu Aduda as Permanent Secretary, Ministry of Petroleum Resources for positive continuity.

    “Aduda obviously has acquired remarkable experiences and built enough capacity to handle affairs of a mainstream and sensitive Ministry that is of great importance to the National Economy, which is clearly shown in his impressive performances in just one year.

    “Staff of the Ministry have testified that they have never had such dynamic and results-driven leadership as his. We therefore do not understand why such impeccable track record should be sacrificed on the alters of political mediocrity in clear violation of all that the civil service holds dear by removing and replacing him with a first-time newly appointed Permanent Secretary and who has only one year to retire from service. What exactly could be the sinister motive for this unholy action?

    “The National Civil Society Council of Nigeria has resolved to occupy the Office of the Head of Service and National Assembly indefinitely if our appeals fall on deaf ears.”

    The Council observed that redeploying Aduda to another Ministry would mean Nigeria losing the seat of Chairmanship of OPEC Board of Governors in 2025 (Flowerbudnews)
