    Alleged underage voters: Court gives INEC 90 days to handover officials responsible for prosecution

     

    Abuja:  A Federal High Court in Abuja has ordered the Independent National Electoral Commission (INEC) to identity, within 90 days, its officials involved in the registration of the underaged during the continuous voters’ registration (CVR) exercise in polling units across the country.

    Justice Obiora Egwuatu, in a judgment, also directed the culprits to be produced and handed over to the appropriate law enforcement agency for investigation and possible prosecution.

    Justice Egwuatu equally made a mandatory order, compelling INEC to expunge forthwith from its national voters’ register the names of all the underage voters from each of the polling unit across the federation published on her website as identified and compiled by the plaintiff in “Exhibit A” attached to the affidavit in support of the originating summons.

    The judge further made a mandatory order,compelling the commission to furnish the plaintiff with a certified true copy (CTC) of the cleaned up national voters’ register of all the persons eligible to vote in Nigeria within 90 days.

    Alternatively, he ordered the electoral umpire to publish the cleaned up national voters’ register of all the persons eligible to vote in the country in its website within 90 days from the date of the judgment.

    The News Agency of Nigeria (NAN) reports that the plaintiff, Rev. Mike Agbon, in the originating summons marked: FHC/ABJ/CS/367/2023 filed on Match 17 through his lawyer, Desmond Yamah, had sued INEC as sole defendant.
    In the suit, the plaintiff posited six questions for determination including “whether the defendant is constitutionally, legally ard duty bound to conduct credible CVR in tre Federal Republic of Nigeria
    “Whether the defendant is bound by the constitution and its enabling statute, the Electoral Act, 2022, to act in strict compliance with the provisions of the constitution and its enabling act.
    “Whether by virtue of Section 23 of the Electoral Act, 2022, it is illegal and unlawful for the defendant to have registered underaged i.e, infants and toddlers, during the CVR.
    “Whether the admission by the defendant that it has a substantial number of the underaged, illegal and illegible voters published in its voters’ register, exonerates the defendant from any sanction within the ambit of the law for registering underaged as contained in Sections 12 & 23 of the Electoral Act, 2022,” among others.
    Agbon, therefore, sought “a mandatory order, compelling and directing the defendant to forthwith within a period of one month to identify, produce and handover its officials that are involved in the registration of the underaged in each polling unit across the federation for investigation and prosecution by the appropriate law enforcement agency,” etc.
    The plaintiff submitted that for many years now, particularly since the return of the country to democratic governance in May 1999, the regrettable issue of lack of credibility of the electoral processes had been a recurring challenge which had greatly distressed the political space.
    He said INEC by virtue of the provisions of the Electoral Act, maintains and updates the national voters’ register.
    Agbon said prior to the 2023 general elections, the electoral umpire conducted CVR nationwide and displayed the national register of voters on its website between the Nov. 12, 2022 and Nov. 25, 2022.
    He alleged that upon perusal of the national register of voters, he discovered that the commission registered underaged contrary to the provisions of the Electoral Act, (supra) which clearly described the qualification for registration.
    The plaintiff backed his argument with compiled copies from the INEC website of the underage registered and marked it as “Exhibit A.”
    He told the court that on Nov. 23, 2022, INEC’s Chairman, Prof. Mahmood Yakubu, at a national stakeholders’ forum on elections organised by the Nigeria Civil Society Situation Room (NCSSR), assured Nigerians that based on the observations of Nigerians, the commission would dutifully clean up the register ahead of the elections.
    Agbon said through his lawyer, he made a formal request for the commission to furnish him with the list and names of the underage and ineligible voters but it vehemently refused and ignored the said application.
    However, despite being served with court processes and hearing notices in the matter, INEC was neither represented in court nor file any defence.
    Delivering the judgment on Nov. 28 but a certified true copy sighted on Monday by NAN, Justice Egwuatu held that the conditions for qualification to be registered as a voter were stipulated in Sections 77 (2), and 117 (2) of the Constitution and Section 12 of the Electoral Act.
    According to him, the common features of these sections are that the voter must be a citizen of and residing in Nigeria and has attained the age of 18 years.
    “As I have found earlier in this judgment, the voters registered by the defendant in Exhibit ‘A’ are underage, that is, they have not attained the age of 18 years.
    “What this translates into is that the registration officers and an update officers of the defendant failed in their duties to carry out the registration of voters in accordance with the provisions of the Constitution and the Electoral Act,” he said.

    Citing provisions of Section 120(1) of the Electoral Act, 2022, he said any officer who acted in breach of his or her official duty committed an offence and would be liable on conviction for a maximum fine of N500, 000 or imprisonment for a term of 12 months or both.(NAN)(www.nannews.ng)/ Flowerbudnews

    Kaduna Villagers Bombed During Maulud Celebration

    Many villagers are feared dead following a bomb allegedly dropped by a Nigerian Air Force jet during a Maulud celebration at Tudun Biri, a community.

    Though details of the incident remain sketchy, preliminary reports indicate that about 30 people died during the incident on Sunday, around 9:00 pm.

     

    Residents told Daily Trust that the bomb struck while the villagers gathered to commemorate Maulud in the village.

     

    “They were celebrating Maulud (birth of Prophet Muhammad) when the jet dropped the bomb, resulting in the immediate death of more than 30 people,” a resident said.

    There is apprehension that the death toll may increase.

     

    When reached for comment, Samuel Aruwan, Overseeing Commissioner of the State Ministry of Internal Security and Home Affairs, did not provide casualty figures, stating that the government would address the media in a press conference at the Government House.

     

    “We will address the press at Government House on the situation because there would be a security meeting later. So, let’s meet by 10 am,” he said.

    Abuja: The Managing Director of the News Agency of Nigeria (NAN), Mr Ali Muhammad Ali, says the media can contribute to the global peace process by building bridges of convergence between diverse people and groups.

    Ali spoke on Monday in Guangzhou, China, at the ongoing 5th World Media Summit.

    The Summit’s theme is “Boosting Global Confidence, Promoting Media Development”.

    NAN reports that more than 400 delegates are attending the summit, with no fewer than 200 of them heads of mainstream media houses.

    Ali, whose speech was entitled “Bolstering Confidence: Media’s Role in Promoting Human Development and Security”, set the tone for the syndicate discussion.

    The NAN managing director also said the media could help promote peace by putting in place early warning mechanisms of potential conflicts or threats to peace.

    Ali, who reflected on the crises bedeviling the global community, expressed the hope that fora such as the summit would further help in peace building, instilling trust in the media as well as promote the industry.

    ”Across the globe, humanity is facing one crisis or the other – economic crisis, environmental and ecological crisis, humanitarian and biodiversity crisis, education crisis, moral crisis, migration crisis, fake news crisis, among others.

    “As a microcosm of the larger global community, the media is reeling under the burden of these crises.

    “It is in the collective interest of our noble profession to use fora such as this to constantly drive conversations around instilling public trust in the media as well as drawing a roadmap for a thriving media industry,” he said.

    The managing director also urged the media to use its vantage position to drive the process for sustainable human development and security across the globe.

    Abuja:  The Federal Inland Revenue Service (FIRS), has approved amnesty on penalties and interests for outstanding tax liabilities.

    The Chairman of FIRS, Zacch Adedeji, said this in a statement on Sunday in Abuja.

    The News Agency of Nigeria (NAN) reports that the FIRS imposes sanctions and interests for failure by companies to fulfil their tax obligations.

    Adedeji said that the step was in recognition of the challenges that many taxpayers had faced in settling their tax obligations.

    He said that it was a demonstration of President Bola Tinubu’s commitment to support businesses.

    According to him, full payment of outstanding original tax liabilities without interest on or before Dec. 31 must be done by companies wishing to benefit from the concession.

    “Taxpayers are advised that the waiver of interest is subject to the full settlement of outstanding principal on or before 31 Dec. 2023.

    “Please note that the full penalty and interest shall be reinstated after the expiration of this one-off concession window where the outstanding undisputed liability remains fully or partially unpaid.

    “The Service appreciates all taxpayers who have been diligent in complying with their tax obligations as and when due while seeking their continued support and cooperation for a more responsive and robust tax system,” he said. (NAN) (www.nannews.ng)/ Flowerbudnews

    Abuja: A former member of the House of Representatives, Robinson Uwak, on Sunday, said the N27.5 trillion budget of President Bola Tinubu would create activities for generation of jobs for Nigerians

    Uwak, who described the budget as “unprecedented” in a statement in Abuja, congratulated Tinubu and his team for the successful presentation of the 2024 Appropriation Bill to the National Assembly for consideration.
    The News Agency of Nigeria (NAN) reports that the budget estimate of N27.5 trillion, which was christened “A Budget of Renewed Hope,” placed priorities on security, economy, education and poverty alleviation.

    The former lawmaker said the budget would impact positively on the lives of the citizens of Nigeria and kickstart the economy.

    Explaining how the budget would impact Nigerians, Uwak said with expenditure in security and defence, more farmers would be able to return to their farms to produce foods, while human capital expenditure would continue to strengthen other areas of national development.

    While expressing optimism that more activities in infrastructure and economy would be witnessed soon, he commended the National Assembly for their quick attention to the budget.

    “After the budget presentation, we saw the expeditious action by the National Assembly to pass it through the second reading, thus providing hope of an early passage and implementation.

    Framework to regulate use of chemicals operational in 2024 — Institute

    Abuja:  The President, Institute Of Chartered Chemists Of Nigeria (ICCON), Prof. Fanna Abdulrahman, says beginning from 2024, a framework aimed at regulating use and application of chemicals will become operational.

    Abdulrahman disclosed this on Monday in Abuja during the 18th Mandatory Continuing Programme Development workshop organised by the institute with the theme “Chemistry for Better Health.”

    According to him, the framework, which is presently going through the process of approvals, will give chemists the authority to examine and analyse the use of chemicals.

    She said emphasis would be on those who use chemicals indiscriminately for all kinds of things and people that have no right handling chemicals but were handling them.

    She explained that “by the end of this year, and especially at the beginning of 2024, we believe that our regulatory framework will have been assented to by the National Assembly.

    “And we will be able to enforce the framework on indiscriminate use of chemicals.

    “We will then have the power to enforce the provisions of the framework on people that are using chemicals wrongly, especially those who are also producing.

    “Right now, we have certification from the Office of the National Security Adviser (ONSA) that enables us to be on the end user certificate of importing some specialised chemicals.

    “That’s a very big thing because we are working alongside NAFDAC, once our regulatory framework has been assented to, it also means that we will have the right to look at the premises and everything that goes with the utilisation of chemicals.”

    Abdulrahman also said that the institute was able to register about 100 chemical companies and other companies importing chemicals in 2022.

    She added that the institution recently commenced the issuance of practicing licence to eligible members in February.

    The policy, she said, was to ensure that only qualified and up-to-date chemists were allowed to practice in the country.

    “The institute also inaugurated its Chemical Security and Safety Programme.

    “The programme is designed to ensure the safety and security of workers and chemical facilities from many threats in the country, such as chemical terrorism, biohazards, insider threats, theft and diversion for use.”

    According to Abdulrahman, Nigerians are constantly exposed to chemicals that have the tendency to create some health challenges.

    She added that chemistry has a role to play in health and diseases, as most sicknesses have their etiology in some biochemical processes, and that the chemicals have the tendency to trigger most of the elements.

    The Minister of Environment, Mr Balarabe Lawal, said that the theme of the workshop is significant because the health sector is important.

    Represented by Prof. Aliyu Jauro, the Director General, National Environmental Standards and Regulations Enforcement Agency (NESREA), Lawal said that finding innovative solutions for Nigeria’s healthcare challenges required multi-disciplinary collaboration in cutting edge research and environmental stewardship.

    He said “we recognise the essential role of chemistry in advancing medicinal research and development, understanding the impact of genes and environmental factors on diseases and improving drug discovery processes.

    “Comprehensive chemistry practices throughout the pharmaceutical industry will undoubtedly contribute to decent environmental impact, lowering healthcare cost and ensuring global access to essential medicines.”

    In his presentation, Dr Edwin Edeh, the Programme Manager, Public Health and Environment Programme, World Health Organisation (WHO), said there are more than 160 million chemicals known to humans.

    He also said that chemical pollution negatively impacted a range of facets of the ecosystem, which could harm human health, adding that about two million deaths were estimated from a variety of health outcomes, including poisoning, heart diseases, chronic respiratory diseases and cancers which occurred from a small number of chemicals.

    Edeh, however, said there was need to raise awareness about potential exposure, vulnerabilities to and health impacts from chemicals.

    He said that Nigerians also deserved to live healthy and in a clean environment, free from chemicals.

    “Chartered chemists have a critical role to play in improving health outcomes in Nigeria through sound management of chemicals.

    “It is necessary for Nigeria to invest in chemical systems surveillance strengthening to achieve good health and sustainable development,” he added.

    Minister shuts down factory in Ogun over unsafe practices

    : The Minister of State for Labour and Employment, Hon. Nkiru Onyejiosha has ordered the shut down of a Metal Manufacturing Company, ‘Gbara’, near Sotubo, in Sagamu local government area of Ogun State, for exposing the its workers to health hazards.

    The company, which is into battery manufacturing and deals with lead however refused to provide protective gear for its workers, despite several warnings from the Occupational Safety and Health department of Federal Ministry of Labour and Employment.

    Onyejiosha disclosed that the recalcitrant attitude of the management of the company to abide by the law of the country and ensure that its workforce operates according to global standards practice forced her to come and ensure that the law of the land is upheld.

     

    Onyejiosha who stormed the factory around 2pm, said that President Bola Tinubu’s administration will never condone any act of sharp practices that will undermine the health of its citizens.

     

    She said, “after being told of what is happening here at this company, I told my staff to come around and instruct them to do what the law says, because they deal with lead which is quite harmful, I told them that the company should do some cleaning up and ensure that their workers are properly kitted so that their lives will not just be endangered unnecessarily, but I later got the report that the company refused to heed the advice.

     

    “So I said, let me come here from Abuja to see things for myself and what I saw was worse than what was described to me. It was totally awful and unacceptable.

     

    “I have never seen the kind of irresponsibility I am seeing at this factory from any manufacturer though, they are telling me that theirs is still better, but I have told them that President Bola Ahmed Tinubu’s administration will never tolerate this illegality, expecially for those who considered the country as dumping ground and where they could get cheap labour and do things to suit them, making money at the expense of Nigerians.

     

    “I have seen things for myself, we met the workers without their boot on, packing things with their hands, no helmet on their heads. No, this is wrong because those running this company won’t dare do this in their country. So, we have gone round and seen things for ourselves and I have pronounced that the company is prohibited until the management is ready to do things as it is provided for in the laws of our land.

     

    “President Tinubu’s government is really against these sharp practices and for those who are not ready to operate according to the rules of the land, they are free to wound up and go, they should stop subjecting our people to such dehumanising conditions under the guise of providing employment for them”.

    No fewer than 135 directors, deputy directors, assistant directors and other officials in the Federal Civil Service have been redeployed to new Ministries, Departments and Agencies

    Details of the redeployment of the affected 135 civil servants were contained in a memo by the Office of the Head of Civil Service of the Federation dated November 30, 2023, which was obtained by our correspondent in Abuja on Friday.

     

    The memo which was tagged, “HCSD/CMO/EM/CPA/908/III/154” was addressed to the Chief of Staff to the President, Femi Gbajabiamila; the Secretary to the Government of the Federation, George Akume; the Chairman of the Federal Civil Service Commission; the Chairman of the Economic and Financial Crimes Commission, the Chairman of the Independent and Corrupt Practices and Other Related Offences Commission, and all permanent secretaries, among others.

    The memo which was signed by the Permanent Secretary, Career Management Office of the OHCSF, Marcus Ogunbiyi, read, “I am directed to convey the approval of the Head of the Civil Service of the Federation for the deployment of the following officers in the Federal Civil Service. Please note that all deployed officers must be accepted and documented by the respective ministries as rejection of officers would not be condoned by the Office of the Head of Civil Service of the Federation. All handover and taking-over processes must be completed on or before Thursday, 7th December 2023.

     

    “All Directors of Human Resources Management and Administration are required to submit details of compliance to this posting instruction to the Permanent Secretary, Career Management Office, Office of the Head of Civil Service of the Federation no later than Monday, 11th December 2023.

     

    “All officers concerned are reminded that failure to adhere to this posting instruction contravenes the position of the Public Service Rule 100301b and 020602[iv] and will be met with appropriate sanctions
