  • Edo: Court hears Philip Shaibu’s contempt charge against Omobayo Oct. 24

     

     

    A Federal High Court in Abuja, on Tuesday, fixed Oct. 24 for the hearing of a contempt charge filed by the reinstated Deputy Governor of Edo, Philip Shaibu, against Godwins Omobayo, over alleged refusal to obey court judgment.

    Justice James Omotosho fixed the date after Shaibu’s counsel, Reuben Egwuaba, informed the court that a contempt charge had been filed for the committal of Omobayo, who took over as deputy governor, to prison due to his refusal to comply with the valid order of the court.

    Justice Omotosho equally ordered that Omobayo be served with all the court documents, including Form 49, filed on Sept. 19 in order to be given the opportunity to purge himself of the contempt charge.

    “This matter is hereby adjourned to 24th day of October for hearing of the motion on notice dated 13th September and filed 19th September seeking for committal of Engr Marvellous Godwins Omobayo and to give him opportunity to defend himself.

    “I hereby made an order that the motion be served on Marvelous Godwins Omobayo to enable him file necessary defence ,” the judge said.

    Earlier, Egwuaba prayed for a short adjournment since the current state government’s tenure would be coming to an end on Nov. 12.

    The lawyer said the court judgment delivered on July 17 was duly served on Omobayo and that several letters were also written to the house of assembly but to no effect.

    It was earlier reported that Justice Omotosho, on Tuesday, also struck out the two separate motions filed by the Edo Government and the house of assembly challenging the reinstatement of Shaibu as deputy governor.

    The judge, in a ruling, also awarded the cost of N200, 000 each against the state government and the assembly, making a total of N400, 000.

    The development followed an application by lawyer to the state’s Attorney-General (AG), Marvin Omorogbe, and that of the house of assembly, Sonia Egbunia, seeking to withdraw the motions for stay of execution.

    They said the intention to withdraw the motion was as a result of the records of appeal which had been transmitted to the Court of Appeal.

    Although Egwuaba, who appeared for Shaibu did not opposed their intention to withdraw the two motions, he, however, asked the court for a N50 million cost each against the AG (3rd defendant) and the assembly (6th defendant) but the judge awarded the sum of N400, 000 against the two defendants.

    The News Agency of Nigeria (NAN) reports that Justice Omotosho had, on July 17, voided the impeachment of Shuaibu as the deputy governor of Edo by the house of assembly.

    The judge, in the judgment, ordered his reinstatement to office on the grounds that the house of assembly failed to comply with due process in the purported impeachment.

    Justice Omotosho also held that the allegation on which the assembly based the impeachment proceedings was untenable in law and did not constitute a gross misconduct.

    The judgment was on the suit marked: FHC/ABJ/CS/478/2024 with Shuaibu as the plaintiff.
    The reinstated deputy governor had sued the Inspector-General of Police (IGP), the Deputy Governor of Edo, the AG, Chief Judge of Edo, Speaker of Edo House of Assembly and the Edo State House of Assembly as 1st to 6th defendants respectively.

    Omobayo was, on April 8, sworn in as the new deputy governor after Shaibu’s impeachment by the state’s house of assembly.

    The Independent Media and Policy Initiative (IMPI) has described attempts being made by some civil society groups to denigrate the outcome of the Edo State Gubernatorial election as a partisan hatchet job not backed by facts.

    In a statement signed by its Chairman Niyi Akinsiju, IMPI noted that claims made by the coalition were a carbon copy of the position of the Peoples Democratic Party (PDP) on the election process.

    It said: ” We have observed the desperate move by the coalition of civil society groups to cast aspersions on the outcome of the 2024 Edo State off-cycle gubernatorial election by tagging collation of results as not transparent. We totally reject their claim.

    “We are, especially, at odd with the undisguised partisanship expressed in the publicly circulated statement by the coalition of the civil society groups to denigrate the electoral process which, indeed, is an amplification of the unfounded allegations of electoral process compromise made by the Peoples Democratic Party (PDP).

    “We do not consider this self-righteous intervention by the coalition of civil society groups as motivated by public interest or as objective arbiters in the concluded electoral matters. We, therefore, urge these groups to be circumspect in the way they leverage their clout to traduce the Edo gubernatorial election outcome with obvious intent at serving narrow partisan interests. This is against the time tested civil society’s public interest code of moderating and facilitating, in an equitable manner, the peaceful development and sustenance of a society.

    “After we reviewed the content of the statement issued by the coalition of the six civil society groups, the clear impression we got is that of the voice of Jacob and the hand of Esau.

    “The various allegations of electoral malfeasance itemised against the Independent National Electoral Commission (INEC) as they relate to reports of disruptions of collation of votes count at collation centres and attempts to collate results against electoral provisions are the same positions canvassed by the PDP. So also, the curious accusation of intimidating INEC officials is part of the omnibus allegations made by the leadership of PDP’s Edo State Gubernatorial Council at the different press conferences it held during the course of the election but strangely captured in the statement issued by the coalition of the the civil society groups.

    “We consider this disappointing because the coalition is expected to serve a higher calling than the nebulous generalisation of the events of the election that it attempted to choreograph pursuant to an agenda to denigrate the Edo State gubernatorial election process in the minds of the larger Nigerian public. Their sole aim is to present the election as one that was compromised and violent, a claim that is spurious.

    “From our standpoint, these claims do not tally with the reality of the conduct of the election as reported by accredited monitors and observers deployed by the Independent Media and Policy Initiative and other observers that monitored the same election.

    “As a matter of fact, the consensus of voters and groups of observers and monitors deployed throughout the state was that the peace and calm that characterised the election from the commencement to the conclusion of voting was contrary to the statewide expectations of violence that had gripped people in the state in the run up to the election”

    The policy group also dismissed allegations of partisanship against the security agencies, especially the Police as baseless.

    According to IMPI, the police team led by Mr Frank Mba, a Deputy Inspector General, did a great job devoid of bias.

    “Concerning the conduct of personnel of security agencies raised by the coalition, our team of monitors and observers found reasonable causes to commend the comportment of security personnel at polling units and collation centres.

    “We specially commend officers and men of the police force for providing an all- inclusive coverage for officials of the Independent National Electoral Commission (INEC) at ward, local government area, and state collation centres.

    “Our onsite participants’ observation of goings-on during the collation at different centres put the lies to claims by the CSOs that only members of the All Progressives Congress (APC) were allowed unfettered access to the collation. We assert that this allegation is baseless and untrue and should not be made by any self respecting group.

    “Indeed, we attest to the fact that the collation of results of the governorship election was disrupted on Sunday at Oredo and Ikpoba/Okha local government area collation centre when observers and officials of the Independent National Electoral Commission (INEC) were tear-gassed by security personnel.

    “Election Observers that witnessed this incident reported that it was as a result of some PDP stalwarts’ violent attempt to access the collation centres.

    “In fact, we can report that while the incumbent Governor of the State, Mr Godwin Obaseki, easily accessed the office of the State’s INEC, the leadership of the APC that included its National Secretary were stopped from gaining entrance into the same office by very stern looking security personnel. This led to the uproar against Obaseki’s privileged access to the office.

    “To restore the balance of sensibility, Deputy Inspector General Frank Mba had to drive down to the INEC’s office to ask the Governor to leave because he was in breach of the law by literally occupying the INEC’s office with obvious intent to intimidate officials with his presence.

    “In addition, we can affirm that some politicians, obviously in realisation of their party losing the election, made desperate efforts to create a stampede situation around the State’s collation centre by inciting some people to violence but the move was soon jettisoned for lack of enthusiasm by the same people that were mobilised to the centre.

    “On a general note, may we appeal to all interested parties in the matter of the Edo State gubernatorial election to moderate their bitterness and conflict from the outcome of the election, even if it is only to depart from the tradition of unfounded outcry and bickering that normally attend the conclusion of electoral contests in Nigeria,” IMPI added.

    Abuja (Flowerbudnews): President Bola Ahmed Tinubu has rejoiced with Senator Monday Okpebholo, the All Progressives Congress (APC) candidate over his victory in the just concluded Edo state governorship election.

    In a congratulatory message to Okpebholo and the people of Edo state, President Tinubu welcomed the APC victory and commended the peaceful conduct ot the election, a statement by the Special Adviser to the President on Information and Strategy, Bayo Onanuga has disclosed.

    Senator Okpebholo was declared the winner by the Independent National Electoral Commission (INEC) on Sunday, having defeated other contenders for the position.

    President Tinubu commended APC national leaders, Edo State leaders, and party governors for working hard to achieve victory.

    He said the victory testified to the people’s support for the ruling party, its progressive ideals, its economic reengineering programme and its commitment to improving the lives of Nigerians.

    He urged Senator Okpebholo not to gloat over his victory but to see it as a challenging call to service. He encouraged him to demonstrate magnanimity by reaching out to his political rivals and uniting the people of Edo State to ensure its development.

    President Tinubu also praised other candidates who participated in the election for their contributions to advancing Nigeria’s democracy, saying peaceful political contests, such as the one on Saturday, portray Nigeria as a stable democracy.

    The President urged all those aggrieved by the election outcome to seek redress through the legal channels.

    In addition, the president commended the people of Edo State for their orderly and peaceful conduct during the election, underscoring the maturing of Nigeria’s democracy after 25 years.

    “I commend the INEC and our security agencies for working round the clock to conduct a successful, peaceful and largely hitch-free exercise.

    “INEC has once again demonstrated that it is committed to organising a free and fair election in our country”, President Tinubu says,” the President said.

    The All Progressives Congress has taken a commanding lead in Saturday’s governorship election in Edo State.

    Before the announcement of a break at the collation centre in Benin City, the Edo State capital, at about 2:10pm, APC was in the lead.

    It had won in 10 out of the 16 local government areas where the results had been announced.

    Edo State has 18 local government areas.

    The Peoples Democratic Party took the remaining six local government areas.

    The results from two local government areas were still being expected.

    The collation of result will resume at 5pm.

    The Edo State Police Command said it has rescued a kidnapped victim, recovered his car and is now on the tail of one of the fleeing gang members.

    The Edo State Police Public Relations Officer and a Superintendent of Police, Moses Joel Yamu, revealed this in a statement to newsmen

    Yamu explained that on September 15, 2024 at about 9:15pm, operatives of Ugbowo Division responded to a distress call from one Valentine Igbinevbo of 19th Street, Ugbowo, who said that his silver-coloured Mercedes Benz C350 car with registration number KWL 195 KC was snatched at gunpoint by two armed men.

    The distraught man also told police that his friend, Iyobo Ighodaro, 21, was abducted in the car from his hostel.

    In a swift response, the Divisional Police Officer and a Chief Superintendent of Police, John O. Emmanuel, mobilised and personally led a surveillance team, traced the suspects to their hideout in Egor, where they were negotiating for ransom using the victim’s phone.

    On sighting the police, a gun battle ensued, where one male suspect, whose identity is yet known, sustained fatal gunshot injuries and was rushed to the hospital, but was pronounced dead, while his colleague is believed to have narrowly escaped with gunshot injuries.

    Yamu said: “The operatives recovered the said vehicle, one cut-to-size gun, one live cartridge, a cutlass and three phones of a different make.

    “Meanwhile, the victim was rescued unhurt, received medical attention and reunited with his loved ones while the corpse of the suspect was deposited at the University of Benin Teaching Hospital (UBTH).

    “The Commissioner of Police, CP Nemi Iwo, commended the DPO and his operatives for their effort in combating crime and further warned all criminal elements in the State that their days are numbered if they continue in crime.

    Edo election: Benin Residents troop out to vote under heavy downpour

    RESIDENTS of Benin, the Edo capital on Saturday trooped out in their numbers to cast their votes defying the heavy rain in the ongoing governorship election in the state.

    The News Agency of Nigeria (NAN) reports that the election is to elect a successor to outgoing Gov. Godwin Obaseki, whose tenure expires in November.

    At the Eresonye Primary School Ward 12, in Ovia North Local Government Area, near Benin, voters filed out in their numbers not minding the rains in order to exercise their electoral franchise.

    NAN reports that although the process has been peaceful, there was an unusual absence of security personnel in the area.

    Some of the voters who spoke with NAN commended the INEC officials for the timely arrival of election  materials and the early commencement of accreditation and voting.

    At the Oredo ward 11 polling booth, police personnel at the gate refused journalists entrance to monitor the process even after they had presented INEC accreditation tag and official identity card showing they had been cleared to cover the election.

    Similarly at the Itohan Grammar School ward on Sakponba road in Ikpoba-Okha Local Government Area, voters were seen in their numbers exercising their electoral responsibilities even with the rains falling heavily. (NAN)

    Abuja:  The Centre for Credible Leadership and Citizens Awareness (CCLCA), has urged stakeholders to adhere to ethical conduct and respect for human rights during the Sept. 21 Edo governorship election .

    Dr Gabriel Nwambu, Director-General, CCLCA, a coalition of INEC accredited observer organisations, made the call in a statement on Tuesday in Abuja.

    He said that the coalition is concerned about recent reports by their election observers of alleged unlawful arrests, and detention of members of the ruling political party in Edo.

    “These actions are perceived as unethical, aimed at weakening the ruling party and stifling their ability to participate in the upcoming governorship election in the state.

    “As INEC Accredited Observer Organizations, it is our duty to advocate for credible, transparent, and free elections, where all citizens can exercise their democratic rights without fear or coercion.

    “It is in this regard that we are urgently notifying the Inspection-General of Police, Mr Kayode Egbetokun, as well as the head of the Department of State Services (DSS),“he said.

    He urged the Nigerian Security and Civil Defence Corps, and the Military to ensure that their personnel comply with ethical standards, and respect the fundamental human rights of all individuals.

    Nwambu called on Egbetokun, as the highest-ranking police officer in Nigeria, to take decisive action to release all persons unlawfully arrested and detained in Edo.

    He said these actions are not only contrary to the principles of democracy but also a violation of citizens’ fundamental rights.

    Nwambu said it was imperative that all security agencies embrace the rule of engagement in line with global best practices, and the provisions of the Constitution of the Federal Republic of Nigeria.

    “This is crucial for upholding the credibility of the electoral process and ensuring the preservation of peace and stability in Edo.

    “CCLCA reiterates its commitment to promoting transparency, accountability and the rule of law in all electoral processes.

    “We call upon all relevant authorities to address this urgent matter, providing a level playing field for all political parties and citizens to exercise their democratic rights devoid of intimidation or harassment.

    The candidate of the All Progressives Congress (APC) in the Edo State governorship election, Monday Okpebholo, has advised his counterpart in the Peoples Democratic Party (PDP), Asue Ighodalo to withdraw from the race.
    Okpebholo stated that his demand was due to the failure of Ighodalo as the Economic Adviser to Governor Godwin Obaseki.

    He alleged that Ighodalo’s roles as an economic adviser plunged the state into huge debt.

    The governorship candidate stated this on  Tuesday during a meeting with the Edo State chapter of All Farmers Association of Nigeria (AFAN) in Benin City.

    He lamented that it was a sad story that the man who had failed Edo State was bringing somebody who was his economic adviser.

    “I told myself that if I was Barrister Ause Ighodalo I would not bother myself to contest the governorship election because a government that I am an economic adviser in has failed.

    “Where I came from, which is Esanland, we were taught morals and anything that is bad or spoiled we don’t eat”, he said.

    The APC governorship candidate lamented that the current debt profile of the state was over ₦573 billion from the inherited ₦43 billion.

    He also alleged that the rate of stealing in the Obaseki-led government was unprecedented, advising the people of the state not to allow the stealing to continue with his third-term agenda through Asue Ighodalo.

    “In Edo State, do you know that the debt profile of the state at the moment is over N573 billion. That is what Edo State is owing now.

    During Adams Oshiomhole’s period, monthly allocation from the Federation Account was between N3.1 billion and N3.3 billion but today the allocation is between N11.1 billion and nothing to show for it.

    A Federal High Court, Abuja, on Friday, dismissed the suit filed by Kenneth Imansuangbon, seeking the disqualification of Olumide Akpata as Labour Party (LP)’s candidate for the Sept. 21 Edo governorship election.

    Justice Obiora Egwuatu, in a judgment, dismissed the suit on the grounds that the suit was statue barred, having been filed outside 14 days after the cause of action arose.

    The News Agency of Nigeria (NAN) reports that the LP conducted its governorship primary election in Edo on Feb. 23, where Akpata won and was declared as the winner.

    Dissatisfied with the declaration, Imansuangbon, through his Counsel, Anthony Malik, SAN, filed the suit marked: FHC/ABJ/CS/472/2024 to challenge Akpata’s emergence.

    In the originating summons dated and filed on April 12, Imansuangbon sued Akpata, Oluyinka Alufohai, LP and Independent National Electoral Commission (INEC) as 1st to 4th defendants respectively.

    The plaintiff had prayed the court to invalidate Akpata and Alufohai’s nomination as governorship and deputy governorship candidates of LP on the ground that Akpata submitted forged documents in his FORM EC9.

    But Akpata, through his Counsel Johnson Usman, SAN, filed among other processes, a notice of preliminary objection, challenging the competence of the suit on the ground that it was statute barred and the court lacked the jurisdiction to entertain it.

    Usma equally argued that the originating summons was incompetent, having been accompanied by an incompetent written address.

    Delivering the judgment, Justice Egwuatu upheld Usman’s objection and agreed with the senior lawyer’s argument.

    The judge, who held that the suit was statute barred, said the court lacked the jurisdiction to entertain the suit.

    He subsequently dismissed the suit, thereby affirming the nomination of Akpata and Alufohai by the party.
