    Oyo State Governor, Seyi Makinde, has lost his eldest brother, Engineer Sunday Makinde, who passed away at the age of 65.

    According to a statement by Chief Olumuyiwa Makinde, the Bada Olubadan of Ibadanland, Engineer Sunday Makinde’s sudden death occurred at his Ibadan residence at 3:20 am on Friday, January 24, 2025.

    The late Engineer Sunday Makinde is survived by his siblings, including Governor Seyi Makinde, as well as children and grandchildren.

    This loss comes as a sad reminder of the governor’s previous experience with bereavement, having lost his mother, Mrs. Abigail Makinde, in 2020.

    The 1999 constitution (as altered) is very clear, explicit and unambiguous that each of the 3 arms of government: the executive, the legislature and the judiciary should adhere to their separate constitutional roles and no one arm should interfere with the functions of the other arm while working towards the same objective to preserve the rule of law and protect the public interest.
    .
    These relevant sections state that:
    EXECUTIVE: Section 5. (1) Subject to the provisions of this Constitution, the executive powers of the Federation:
    b) shall extend to the execution and maintenance of this Constitution, all laws made by the National Assembly and to all matters with respect to which the National Assembly has, for the time being, power to make law

    JUDICIARY: Section 6. (1) The judicial powers of the Federation shall be vested in the courts to which this section relates, being courts established for the Federation.

    To this extent, President Buhari lacks the powers to release Nnamdi Kanu because the 1999 constitution says the President has no judicial powers and judicial powers are vested in the courts.

    The combined effect of sections 5 and 6 of the 1999 constitution also asserts that the executive should allow the judiciary to do its job.
    By sticking to the constitutional provision of separation of powers, President Tinubu has been able to maintain a very stable relationship between the 3 arms: executive, legislature and the judiciary largely because he doesn’t interfere with the functions of the other arms (especially the judiciary).

    President Tinubu deeply respects the principle of separation of powers and this position helped him and his government in relations with the other arms of government to implement government policies and programmes.

    Releasing Nnamdi Kanu will rock the boat, abuse the constitutional doctrine of separation of powers and change the current harmonious working relationship between the executive and the judiciary. The Tinubu administration cannot afford a frosty relation between the 3 arms especially at this time of very serious insecurity engulping the entire nation.

    PREROGATIVE OF MERCY
    Albeit the 1999 constitution has restricted the powers of the President to interfere in legislative and judicial matters based on the doctrine of separation of powers as enshrined in sections 4,5 and 6, it has given the President a window for clemency to persons either undergoing trial or convicted of an offence. This is spelt out in section 175 which grants powers for clemency on the President in consultation with the national council of states.

    S.175 states inter alia, that
    (1) The President may –
    (a) grant any person concerned with or convicted of any offence created by an Act of the National Assembly a pardon, either free or subject to lawful conditions;
    (b) grant to any person a respite, either for an indefinite or for a specified period, of the execution of any punishment imposed on that person for such an offence;
    (c) substitute a less severe form of punishment for any punishment imposed on that person for such an offence; or (d) remit the whole or any part of any punishment imposed on that person for such an offence or of any penalty or
    forfeiture otherwise due to the State on account of such an offence.
    (2) The powers of the President under subsection (1) of this section shall be exercised by him after consultation with the Council of State.

    Despite this window given to the President to exercise the prerogative of mercy, it is clear that releasing Nnamdi Kanu could potentially jeopardise the public interest and promote further violence. A political solution cannot be applied where there is clear and real danger to the public interest.

    PUBLIC/NATIONAL INTEREST
    Using section 175 of the constitution to release Nnamdi Kanu could tantamount to abusing the constitution due to the overriding consideration of PUBLIC INTEREST and NATIONAL SECURITY. Nnamdi Kanu, a global fugitive has made it very clear in words and actions, on both print and electronic media notably through the secessionist so-called Radio Biafra which he operates from abroad, that he is out to destabilise Nigeria using every available means and is a clear threat to national security.

    Mr Kanu did not just stop at threats but he went on to establish the so-called independent people’s of Biafra (IPOB) and it’s militant wing, the Easter Security Network (ESN) which is currently waging what they call ‘campaign to achieve Biafra’ by visiting an unprecedented level of violence in the South eastern part of Nigeria. Without the gallant efforts of our military and other security agencies, the situation in the South east is better imagined than witnessed.

    IPOB and ESN secessionists have been alleged to be involved in the killing of innocent people including security agents. The secessionists have also displaced hundreds of thousands of people and are on the march to creating a very serious humanitarian crisis in the South-East geopolitical zone.
    In the light of all these realities, Mr President shouldn’t succumb to pressure to release Nnamdi Kanu but should allow the judiciary complete its job on Mr Kanu even if to serve as a deterrent to other wannabe secessionists who want to disturb the fragile peace in Nigeria.

    Someone who is plotting to dismember Nigeria in his quest for ‘Biafra’ deserves no clemency from the same constitution he doesn’t recognise.

    The President is also mandated by the constitution to implement and maintain the constitution. This is clearly stated in section 5(1)(b) that:
    ‘The executive powers shall extend to the execution and maintenance of this Constitution, all laws made by the National Assembly and to all matters with respect to which the National Assembly has, for the time being, power to make laws’

    Clearly section 5(1)(b) has given credence on the need to safeguard the sanctity of the constitution and releasing Mr Kanu could distort this requirement.

    Releasing Nnamdi Kanu will violate sections 2 and 3 of the constitution which clearly indicate that there shall be a nation called Nigeria comprising of 36 states and the federal capital territory: Nnamdi Kanu has repeatedly, persistently, publicly and unapologetically said he doesn’t believe in Nigeria and called our dear motherland a ZOO.

    Nnamdi Kanu should be made to understand that there is the need to think before action not action before thinking.

    Let the law run its full course on Nnamdi Kanu even if to serve as a deterrent to wannabe secessionists that the civil war ended on 15 January 1970.

    NOLLE PROSEQUI
    The prerogative granted to Mr President on the powers to release a suspect or convict by the 1999 constitution (as altered) may be exercised through the attorney – general of the federation. In this manner, the President may direct the attorney – general of the federation to withdraw or review the charges against the suspect.
    As a matter of fact, the constitution has also given direct powers to the attorney- general of the federation to discontinue a case or withdraw charges against a suspect as contained in section 174.
    Without prejudice to section 174. (1) of the 1999 constitution (as amended) on the concept of NOLLE PROSEQUI which empowers the attorney-general of the federation to withdraw charges on persons undergoing trial in a court of competent jurisdiction, it must be observed that this is allowed only if it doesn’t jeopardise the PUBLIC INTEREST.
    Section 174 (1) (c) states that:
    The Attorney-General of the Federation shall have power –
    (c) to discontinue at any stage before judgement is delivered any such criminal proceedings instituted or undertaken by him or any other authority or person.

    Section 174(3) is clear that in exercising these powers to discontinue a case, the attorney – general of the federation must consider the PUBLIC INTEREST. The relevant section 174 (3) is unambiguous that:
    ‘In exercising his powers under this section, the Attorney-General of the Federation shall have regard to the PUBLIC INTEREST, the interest of justice and the need to prevent abuse of the legal process.
    In this context, it is clear that NOLLE PROSEQUI is not a blank cheque for the attorney- general of the federation to withdraw charges at will. Indeed, withdrawing charges and releasing Nnamdi Kanu could tantamount to the following:
    1. Jeopardising the PUBLIC INTEREST as Mr Kanu could potentially continue from where he stopped in mobilising members of the outlawed independent people of Biafra (IPOB) to continue their violent campaign across the South East.
    2. Abuse the LEGAL PROCESS as the judiciary has commenced the trial of the Mr Kanu since 2016 and ongoing. It will be counter-productive to discontinue Nnamdi Kanu’s trial at the middle of it. The legal process is on course to prosecute Nnamdi Kanu and take the case to its logical conclusion.
    There is absolutely no reason to stop the trial.
    Indeed, the amended charges against Nnamdi Kanu which border on Terrorism and Treason are too weighty to be the ignored.

    SENDING THE WRONG SIGNALS
    Releasing Nnamdi Kanu will send the wrong signals that no matter the weight of your alleged crimes, you can walk free once you have the right connections. Just ask the politicians, elders, elite and traditional rulers in your area to go and put pressure on Mr President to release you.
    It will also make a mockery of the judiciary and disrespect the constitution. Many hardworking people have lost their businesses and other means of livelihood as a result of the so-called sit-at-home order in the South East routinely imposed on the entire South east by the outlawed IPOB/ESN.

    Maj.-Gen. Eyitayo Oyinlola has assumed duty as the General Officer Commanding (GOC) 3 Division of the Nigerian Army, Rukuba, near Jos, and Commander Operation Safe Haven (OPSH).

    Oyinlola took over from Maj.-Gen. Abdulsalam Abubakar, who has been posted to the National Defence College, Abuja.

    He thanked the Chief of Army Staff (COAS), Lt.-Gen. Olufemi Oluyede, for finding him worthy to head 3 Division and OPSH.

    He promised to sustain the successes achieved by his predecessor and ensure lasting peace in Plateau and other areas of responsibility.

    Earlier, Abubakar congratulated the new GOC and commander over his appointment.

    Abubakar, who described the security situation in Plateau and environs as complex, said that hence the need for both kinetic and non-kinetic approaches to tackle it.

    “The dynamics of the security situation in Plateau is complex and necessitates the integration of both kinetic and non-kinetic to tackle it.

    “The situation on the Plateau is different; you will find yourself mediating in conflicts among communities, particularly between herders and farmers

    “The operations here are peoplecentric; we have made personal sacrifices to keep the state peaceful and I know you will do more.

    “I have no doubt that you have all it takes to handle the complex security situation in Plateau and environs,” the former GOC said.

    Abubakar thanked the officers and men of the division and OPSH, for the support and cooperation given to him throughout his tenure and urged them to support his successor.

    He also thanked the government and people of Plateau for supporting him to discharge his duties diligently and called on them to extend same to his successor.

    Abubakar called on heads of other security agencies to collaborate and support the new GOC and commander to succeed in his assignment in the Plateau.

    FLOWERBUDNEWS:  The Lagos State Muslim Pilgrims Welfare Board has urged Muslims in Lagos wishing to perform the 2025/1446 A.H Hajj to obtain form from its office in Ikeja.

    The issuance of Hajj girm started from September last year.

    The Board Secretary, Mr. Saheed Onipede made this disclosure in a recent statement released by the Public Affairs Officer, of the Board, Mr. Taofeek Lawal, a copy of which was made available to Flowerbudnews.

    According to Onipede, the cost of the Hajj form is N20,000.00 (Twenty Thousand Naira only) while intending pilgrims are to pay the sum of N8,500,000.00 (Eight Million, Five Hundred Thousand Naira Only) as initial deposit, pending the official announcement of the actual fare for the 2025 Hajj by the National Hajj Commission of Nigeria (NAHCON).

    Expatiating further, the Board’s Scribe said, “In consideration of the present economic situation of the Country, the Board has decided to make the payment flexible for intending pilgrims to pay the money in installment in order for them to actualise their dream of performing the spiritual obligation in a seamless manner”.

    While urging them not to make payment into personal accounts, Onipede advised that interested Muslims should raise a ‘Bank Draft’ from any of the Commercial Banks in favour of ‘Lagos State Muslim Pilgrims Welfare Board’ and submit same to the Accounts department for collection of official receipt for the value of the sum paid.

    Onipede gave assurances that should the actual Hajj fare finally announced by NAHCON falls below N8.5 million, the Board would refund them with the balance.

    Quoting from the Holy Quran Chapter 22 vs 27, the Board Secretary stated that it is incumbent on every Muslim (male and female) who are mentally, physically and financially capable, to embark on the holy pilgrimage at least once in a lifetime.

    He therefore prayed that Allah in His infinite mercy would provide every intending pilgrim the financial wherewithal to actualize their dream this year, even as he prayed for Allah’s intervention in the crushing economic situation presently being faced by Nigerians.

    He assured every intending pilgrim of the State Government’s preparedness to always make the exercise comfortable for them through a well thought out activities and packages which include, accommodating them in a conducive hotel nearer to Haram both in Makkah and Madinah and Ziyarah (visitation) to historical sites in Makkah and Madinah.

    Others are regular spiritual counselling and guidance on Islamic tenets by Islamic scholars (Ulamah); quality foods in local delicacies (twice daily) and provision of medical care, amongst others. (FLOWERBUDNEWS)

    Ikeja:    The Nigeria Customs Service on Thursday decorated no fewer than 106 newly promoted officers with their insignia of office in Lagos.

    The decorated officers included 39 Comptrollers and 67 Deputy Comptrollers of Customs.

    Orbih commended the Comptroller-General of Customs, Bashir Adeniyi, for recognising and rewarding the most hardworking and brilliant officers for their dedication and hard work.

    He said that the newly promoted officers had demonstrated a remarkable proficiency in embracing modern customs procedures and ensuring that high standards were exhibited.

    The National Vice President of the Association of Nigerian Licensed Customs Agents (ANLCA), Mr Segun Oduntan, conveyed greetings from the National President of the association to the newly promoted officers.

    Oduntan expressed that ANLCA, with over 4,000 licensed members, would continue working with Customs to help surpass their targets and emphasised the importance of maintaining engagement with stakeholders.

    One of the decorated Comptrollers, Comptroller Aliya Shuaibu, who was decorated alongside ACG Orbih, expressed his gratitude for being considered worthy of promotion.

    He thanked God, his mentors, parents and family for their unwavering support, which had enabled him to reach a leadership position in the Service.

    The Former Minister of the Federal Capital Territory, Rtd. Lt.-Gen. Jeremiah Timbut Useni is dead.

    Family sources disclosed that he died on Thursday, January 23, 2025, following a protracted illness.

    The passing of the Useni was also contained in a statement in by Governor Caleb Mutfwang of Plateau State via his Director of Press and Public Affairs, Gyang Bere.

    The governor described the demise of General Useni as a tremendous loss not only to his immediate family but also to the Nigerian Armed Forces, Plateau State, and the entire nation.

    According to Mutfwang, General Useni’s exemplary leadership and steadfast commitment to service, which left an indelible mark on Nigeria’s security and political landscape.

    He noted that General Useni’s tireless efforts to promote peace and security, especially in Northern Nigeria and Plateau State, will forever be remembered.

    Mutfwang recounted the career of the late General, whom he said served Nigeria with distinction in various capacities, including as Minister of Transport, Quarter-Master General of the Nigerian Army, and Minister of the FCT.

    “After retiring from the military, General Useni transitioned into politics, where he continued his service to the nation.

    He served as Deputy Chairman of the All Nigeria Peoples Party (ANPP) and was elected Senator representing Plateau South Senatorial District in 2015 under the People’s Democratic Party (PDP),” he said.

    Mutfwang hailed General Useni’s life of selfless service, noting his profound contributions to the military, politics, and his community. He emphasized that the General’s legacy of compassion, kindness, generosity, and dedication to the well-being of others will endure in the lives of those he impacted.

    The police force headquarters in Abuja has provided more details on how the wife of retired Assistant Inspector-General (AIG) Hakeem Odumosu, who was kidnapped on January 16, was rescued unharmed.

    Recall that on January 16, 2025, at approximately 9:45 PM, four masked gunmen forcibly abducted Mrs. Odumosu from her Lexus Jeep outside her residence in Arepo, Ogun State.

    The abduction sparked an immediate response from the anti-kidnapping unit of the Ogun State Police Command, which commenced a thorough investigation and targeted pursuit of the kidnappers.

    Force Public Relations Officer Olumiyiwa Adejobi, who made this known, said that with the support of the Force Headquarters’ technical intelligence platforms, the Ogun State police operatives engaged in extensive surveillance of the creeks surrounding Arepo, gathering crucial information to track down the assailants.

    Their efforts culminated in a raid on January 23, 2025, at around 06:45 AM. The intelligence-led operation took the police to a creek in the swampy area of Ikorodu, where the kidnappers were reportedly planning their next attack.

    Adejobi said that upon arrival, the operatives encountered the kidnappers, who opened fire. In the ensuing confrontation, two of the gunmen were neutralized, while four others fled the scene, abandoning their operational weapons.

    The victim, Mrs. Odumosu, was rescued from the swampy creeks during the operation, unharmed. She is currently undergoing medical evaluation as a precautionary measure and has since been reunited with her family.

    The police also recovered four AK-47 rifles, three locally made single-barrel rifles, ammunition of various calibres, and the sum of N10,000,000 ransom previously demanded by the kidnappers, further ensuring that justice is served.

    The Inspector-General of Police, IGP Kayode Adeolu Egbetokun, has commended the Ogun State Commissioner of Police, CP Lanre Ogunlowo, and his operatives for their gallantry in this successful operation.

    “This operation exemplifies the dedication and resilience of our police officers.

    “The Nigeria Police Force remains steadfast in its mission to combat kidnapping and other violent crimes, providing safety and security to all citizens,” he said.

    Gov. Ademola Adeleke of Osun says his administration’s service delivery to the people of the state is receiving positive rating from the opposition parties.

    Adeleke said this while receiving letter of notification of award as the Governor of the Year from the management of Leadership Group, publisher of Leadership Newspapers, on Thursday in Osogbo.

    The governor, while noting that it may be true that he had delivered a four-year task in two years, said that he would be propelled to do more because the state had been left behind on many fronts.

    “The consensus from those reviewing our performance and service delivery is that we are true agents of good governance.

    “When recently some opposition figures confessed to our positive ratings, I still believe we have a lot of grounds to cover.

    “The state is constantly getting recognitions for what outsiders and even opposition members regarded as our commendable performance.

    “In all these positive ratings, my response has always been to task my team to double their efforts.

    “In the face of overwhelming positive reviews and high approval ratings, I am compelled to drive my team harder.

    “I am not allowing the praises to enter my head,” he said.

    The governor maintained that since the inception of his administration, he has reduced infrastructure deficit by over 40 per cent in the state.

    Adeleke, who commended the management of Leadership Group for the nomination, said that the yardstick the organisation used in recognising him was in line with the similar reasons used by others.

    “In the last one year, our government has been conferred with several awards across all sectors.

    “Aside from reputable newspapers like the Leadership stable, we have received accolades from several federal agencies and non-governmental bodies,” he said.

    Adeleke assured the public that his administration would not slow down in providing good governance to the people.

    In his remarks, Mr Mike Okpere, Vice Chairman, Leadership Group, said the research team of the organisation did a thorough job before arriving at awarding the Best Governor of the Year to Adeleke.

    Okpere said the achievements of the governor in all the sectors of the economy necessitated the award.

    According to him, Adeleke, along with his Akwa Ibom, Enugu, Jigawa and Kano States counterparts will receive the award at the ceremony slated for April 8 in Abuja.

    He said that the Chairman of Dangote Group, Aliko Dangote, will also receive an award at the event.

    Also, Mr Abraham Isaiah, Director, Leadership Group, said the excellent performance of the governor in regular payment of salaries, infrastructure development, health, agriculture education, among others earned him the award.

    The Managing Director of AT-Tameemi, Haj. Yussuf Animashaun, urged intending pilgrims to take advantage of the company’s Pay Small Small Scheme to help as many Muslims as possible to perform 2025 Hajj.

    He reminded intending pilgrims that the National Hajj Commission (NAHCOM) had made it clear that there might be no room for time extension for payment for Hajj this year.

    ”HAJJ 2025/1446AH will not accommodate last-minute decisions,” Haj. Animashaun counselled Muslims.

    ”Plan your Ramadan Umrah and Hajj 2025 trips NOW!,” he stated, praying: MAY ALLAH INVITE US ALL.
