  • Security: Fidelity Bank Donates Three Security Vans To Lagos Traders

(FLOWERBUDNEWS) Fidelity Bank Plc on Monday donated three security vans worth millions of naira to traders in Lagos to boost security in line with its Corporate Social Responsibility (CSR).

The vans were donated to the traders under the umbrella of Auto Spare Parts and Machinery Dealers Association (ASPAMDA), Association of Progressive Traders (APT) and Balogun Business Association (BBA).

Speaking at the official handover ceremony in Lagos, Mr Nnamdi Okonkwo, the bank’s Managing Director, said that the donation was in fulfillment of its promise to the traders three months ago.

Okonkwo said that the bank during an engagement with the traders three months ago realised that their major challenge centred around security.

He noted that the bank decided to facilitate security arrangements by presenting the three security patrol vans to them.

“We went over to ASPAMDA, BBA to see how we could serve them better and in that process a lot of issues came up which included issues about security in that area as well as infrastructure.

“We realised that security was a challenge when we made that visit and that also included the fact that the market does not have security patrol vehicles.

“We did made a promise that we will support them with that and that is why today we are presenting these vehicles to facilitate their security arrangements in the various markets”, Okonkwo said.

He also said that the bank had opened a portal for children and wards of their customers in the market that were unemployed to apply for jobs in the bank.

“As an institution, we do not take deposits and give loans alone, we realised from interaction that most of these customers have wards, children who have gone through university and are not still employed.

“So, we used the opportunity to create a portal for eligible candidates to apply and those that pass the recruitment exercise will be employed by the bank,” Okonkwo added.

Also speaking, Mrs Nneka Onyeali-Ikpe, the bank’s Executive Director, Lagos and South West, said that the gesture was a way of rewarding the traders for their loyalty over the years.

Onyeali-Ikpe said that the bank would continue to deliver to all its customers and stakeholders.

Responding on behalf of the traders, Chief Daniel Oforkansi, ASPAMDA President, commended the bank for its kind gesture of giving back to the immediate community.

“We are happy and it is a big challenge to other competitors in the financial industry as Fidelity Bank has done exceptionally well.

“What they exhibited today shows that they are ready to promote our businesses”, Oforkansi said. (NAN)

Nigeria Conversation is a citizenship mainstreaming initiative which engages Nigerians both at home and abroad in discussion on nation building processes and the need for all-round development of the country.
Bayewumi said, “The present democracy we are practicing is the representative type.

“After electing leaders we must not abandon them. We must be part of the decision-making and governance processes to achieve targets.

“We can achieve that through constructive engagement using dialogue not hate speeches.

“We must engage ourselves because we know our challenges, and we must find ways to address them.”

  • Tax Assessment: Court fixes Jan. 30, 2020 for MTN’s suit against AGF

A Federal High Court Lagos on Tuesday, further adjourned hearing until Jan. 30 and Jan. 31, 2020, a suit filed by MTN Nigeria Communication Ltd, against the Attorney General of the Federation, over alleged N242 billion and 1.3 billion dollars import duties and withholding tax assessments.

Flowerbudnews  reports that MTN instituted the suit by a writ, on Sept.10, 2018, challenging mainly, the legality of the AGF’s assessment of its import duties, withholding tax and value added tax in the sums of N242 billion and 1.3 billion dollars.

The plaintiff is seeking among other declaratory reliefs, a declaration that the AGF’s demand of the sums of N242 billion and 1.3 billion dollars from MTN, is premised on a process which is malicious, unreasonable and made on incorrect legal basis.

When the case was called on Tueday, Chief Wole Olanipekun, SAN, leading a team of other senior lawyers appeared for MTN.

On the other hand, Mr T.A. Gazali, a State Counsel from the Federal Ministry of Justice, alongside Mr Terhember Agbe, announced appearances for the AGF.

Plaintiff’s counsel then informed the court that he was ready to proceed with trial but had been called by the respondent who informed him that he would not be able to proceed with trial as he was representing government in another matter.

Olanipekun also told the court that he had filed a reply to the plaintiff’s motion and had served same on him but added that since the respondent said he required time to study same, it will only be fair to allow him.

On his part, Gazali also informed the court of his motion seeking extension of time to regularise his processes.

Following consensus of parties, Justice Chukwujekwu Aneke adjourned the case until Jan. 30 and 31, 2020 for hearing.

Meanwhile. the court vacated the Nov. 31 initial date.

In its writ of summons, MTN is seeking declaratory reliefs on the following grounds:

That the purported “Revenue assets investigation” allegedly carried out by the Federal Government on MTN, for the period of 2007 to 2017, and its decision conveyed through the office of the AGF by a letter dated Aug. 20, violates the provisions of section 36 of the constitution.

A Declaration that the AGF acted in excess of its powers, by purporting to direct through its letter of May 10, a “self assessment exercise” which usurps the powers of the Nigerian Customs Service to demand payment of import duties on importation of physical goods.

A Declaration that the AGF acted illegally, by usurping the powers of the Federal Inland Revenue Service, to audit and demand remittance of withholding tax and value added tax.

A Declaration that the purported “self assessment” exercise instituted by the AGF via its letter of May 10, is unknown to law, null and void and of no effect whatsoever.

In addition, the plaintiff wants a court order, vacating the AGF’s demand letter dated Aug. 20, for the sums of N242 billion and 1.3 billion dollars from MTN Nigeria Communications Ltd.

Besides, MTN is claiming a total sum of N3 billion in damages, against the defendant, which covers General damages, exemplary damages, and Legal costs.

Meanwhile, in its preliminary objection, the AGF argues that the plaintiff in seeking redress to the subject matter, has just three months from the date the cause of action arose, to institute the action.

It argues that the plaintiff commenced the suit in clear disregard to Section 2 of the Public Officers Protection Act, which provides that any action commenced against a public officer, must be made within three months from commencement of cause of action.

AGF argues that plaintiff’s failure to commence the suit within three months as stipulated by law, robs the court of jurisdiction to entertain same. (NAN))

  • Nigeria Border Closure Hits Hard In Niger Republic

(FLOWERBUDNEWS) Along with Benin, Niger, which shares a 1,500-kilometre (900-mile) border with Nigeria, has been badly hit by the closure of Nigeria’s border.

A long line of lorries from Niger and elsewhere in West Africa is stranded at Dan Issa. Some are full, some laden with goods. The drivers and their assistants sleep on the ground or in the cabins of their vehicles.

All along the 30 kilometre road between the border and the city of Maradi, customs officials and police officers sip tea or coffee and chat.

Groups of young people at a loose end and motorbike taxi drivers short of customers play cards under the shade of the trees.

Three and a half million people live in and around Maradi. Concern and indignation are growing among the people there, most of whom survive on agriculture and trade.

That makes them highly dependent on their southern neighbour Nigeria, the biggest economy in west Africa with its oil riches and 190 million people.

“Maradi is suffocating,” said Ali, a kabou-kabou driver, the local motorbike taxi. “The city is usually bustling with people — now it’s almost dead.”

“We are very angry,” said Ahmadou Amadou, who imports motorbikes for a living. “The business sector is wasting away.” If the border closure continues, then they will be ruined, he added.

“Nothing crosses into Nigeria and nothing comes out. It’s hermetically sealed,” said Amadou Idi, sitting in a makeshift shelter to keep out of the rain, and reflecting on the downturn in his luck.

“We twiddle our thumbs and pray.”

Idi’s job is a transiting agent — to get goods across the border to Nigeria at the Dan Issa frontier post in southeastern Niger.

But he has been out of work since Nigeria dramatically closed its borders with its neighbours on August 20, declaring it wanted to put an end to chronic smuggling.

Some locals remember the last time this happened, back in the 1980s — and it lasted two years. And it was the same president, Muhammadu Buhari, who was responsible.

Buhari closed the borders shortly after he came to power. From April 1984 to February 1986 he kept them closed in response to the falling price of oil, a drop in exports and the smuggling of contraband.

In fact the border was only reopened after Buhari was toppled in a coup.

Amadou Oumarou, another Maradi resident, said his government should sit down at the table with Nigeria and negotiate a solution.

Falling prices are hitting locally made products due to a lack of buyers in Nigeria, while the price of products imported from Nigeria is soaring, he said.

Some traders are selling their rice cut-price just to get rid of their stock, said Chaibou Tchombiano, general secretary of Niger’s union representing traders, importers and exporters.

“We used to sell a 100-kilo (220-pound) sack of cowpeas for 18,500 CFA francs ($30, 27 euros). The price has fallen to 17,000, even 16,000 francs, since the border was closed,” said cereal trader Haruna Moussa.

The impact of the closure is having a ripple effect reaching as far as the capital Niamey, 650 km away.

“A tonne of imported cement (produced by the Nigerian corporation Dangote), which used to sell for 95,000 CFA francs has gone up to 120,000 francs, and cigarettes have risen from 25 to 100 francs each,” said Mamanane Nouri, head of a consumers’ group.

Ironically, one effect of the border closure seems to have been a rise in smuggling, which is taking place under the nose of customs officials.

A steady stream of motorcycles and vans took rice, beans and other products over to Nigeria, cutting trails across fields, an AFP reporter saw.

They came back laden with petrol, sugar cane and sweet potatoes, as well as parts for cars and motorbikes.

As one local, carrying two goats on the back of his bike, put it: “If we just sat there, waiting for the border to open, we’d die of hunger.”

“Here, young people start trading from the age of 12,” said local radio journalist Mansour Sani. “If the border stays closed for a long time, it will be a time bomb.”

  • Akwa Ibom 2020 Budget Among Most Viable – BudgIT

(FLOWERBUDNEWS) The Akwa Ibom state 2020 budget proposal has been identified as one of the most viable in the country.

This was part of a new report released by a budget tracking Civil Society Organisation, BudgIT, recently. It indicated that the budgets of only four states in Nigeria namely Akwa Ibom, Lagos, Rivers and Kano, are viable.

According to the report titled ‘State of States’ which was presented by Research and Policy Lead Analyst for BudgIT, Ojiugo Uche, showed that most states’ economies are tied to informal trade and skeletal industrial output with exception of Akwa Ibom, Lagos, Rivers, Delta and Ogun.

It reads in part, “Most Nigerian states have still not figured out how to harness their collective strengths and establish a single focus on investment products, thereby becoming a fulcrum of productivity and not just FAAC distribution centers.

“In the 2019 report, we made mild changes to our methodology, thereby using actual expenditure for the states, reducing the probability of the unreality of inflated budgeted figures especially for expenditure items”.

Similarly, Akwa Ibom state according to the latest rating released by the Joint Tax Board (JTB) has moved from 16th position on the Internally Generated Revenue (IGR) rating table in 2015 to number six (6) on the table in 2019.

There have been major reforms in tax administration in the state since the Emmanuel administration came on board in 2015.

According to reports, with the latest rating, the state’s IGR reached an all-time high of N24.8billion within eight months, January to August 2019.

This amount represents 57.05 percent of the projected IGR (N43.6billion) for the 2019 business year, a very significant improvement since the return to civil rule and presents a bright outlook for the 2020 budget, which the state governor recently presented to the state legislature.

Speaking on the 2020 budget christened ‘the budget of Industrialization for Poverty Alleviation phase 11’, Gov. Udom said “it is predicated on the 8-point agenda that forms the policy thrust of my completion agenda of industrialization, aviation development, security, infrastructure, small and medium scale enterprises, human capacity development, agriculture, and rural and riverine area development”.

BudgIT worked with state governments on accessing the audited reports for the 36 states in Nigeria. The group maintained that this was to ensure that our fiscal index is more governed by reality than budget figures by states.
