  • Digital Transformation and Accountability: Legacy of Garba Abubakar’s visionary Leadership at the CAC

Digital Transformation and Accountability: Legacy of Garba Abubakar’s visionary Leadership at the CAC

    By  Barr  C N. Okoli

Lagos (Flowerbudnews):  The realm of business and governance has undergone significant transformation, largely driven by the adoption of modern technologies and a strong commitment to transparency.

One individual who epitomized these values during his tenure as the Registrar-General, Alhaji Garba Abubakar of the Corporate Affairs Commission made a substantial impact on the institution.

The former Registrar-General, who is also the grandson of the Prime Minister of Northern Nigeria, Sir Abubakar Tafawa Balewa and whose father resigned from the prestigious Port Authority two weeks after his appointment due to a lack of a clear and proper path to stop ‘business as usual’.

At that point in time, his reason was that: “he wanted to meet his Creator peacefully”. , AG Abubakar inherited a record of prudence.

He was distinguished by his resolute determination to challenge the conventional way of doing things. He recognized the necessity to disrupt the status quo, pushing for substantial changes to enhance efficiency and transparency.

Financial leaks and insider trading have long been issues that hinder the growth of organizations and erode trust. The former Registrar-General tackled these problems head-on.

He implemented rigorous measures to seal financial leakages, ensuring that every Naira allocated to the commission was meticulously accounted for. Additionally, he introduced measures to prevent insider trading, creating a level playing field for all stakeholders.

The integrity of business records and corporate documents is paramount to the credibility of any regulatory body. Preventing tampering with files was a significant achievement during his tenure, guaranteeing the reliability and trustworthiness of the information held by the commission.

One of the most remarkable accomplishments of the former Registrar-General was the bold move towards embracing digital transformation.

Recognizing the potential of modern technology, he spearheaded the commission’s journey into the digital age. This shift streamlined processes, enhanced accessibility, and reduced reliance on outdated paper-based systems.

However, the digitization process was not without its hurdles. Many staff members lacked proficiency in using computers, and there was a widespread fear of potential job losses due to the automation of certain tasks.

This situation underscores the common challenge in transitioning to digital systems: the need for comprehensive training and change management to ensure that employees can adapt to new technologies.

The former Registrar-General’s dedication to accountability and transparency extended to the unearthing of criminal activities within the organization.

His actions revealed connections between certain staff members and various forms of misconduct. These revelations underscore the importance of maintaining rigorous ethical standards and holding individuals accountable for their actions..

The impact of these reforms was not merely anecdotal. The involvement of law enforcement and regulatory bodies, including the Police, DSS, EFCC, ICPC, and AGIES, in validating these claims underscores the seriousness of the former Registrar-General’s commitment to accountability and the fight against corruption.

The tenure of the former Registrar-General of the Corporate Affairs Commission serves as a testament to the transformative potential of digitalization and accountability in the realms of business and governance.

His initiatives to break away from traditional practices, curb financial leaks, and introduce digital innovations have left an indelible mark on the Commission, setting a benchmark for others to follow. This narrative reminds us that, in our ever-evolving world, embracing innovation and upholding accountability can lead to enduring positive change.

As we conclude, it is compelling to contemplate the potential for global institutions, such as the World Bank, to acknowledge and engage in collaborations with prudent and forward-thinking individuals like the former Registrar-General, Alhaji Garba Abubakar.

His leadership and unwavering commitment to instigating change have left an indelible mark on the Corporate Affairs Commission and, indeed, the broader business environment. To further integrate into the Africa Business Platform and spearhead the much-needed transformation, visionary leadership remains an indispensable element.

This narrative serves as a powerful reminder that throughout the African continent, the embrace of innovation and the upholding of accountability can pave the way for enduring positive change while simultaneously acting as a bulwark against corrupt practices in government, non-governmental organizations, and the private sector.

The former Registrar-General’s time at the helm of the Corporate Affairs Commission stands as a testament to the transformative power of digitalization and accountability in the spheres of business and governance.

His efforts to depart from conventional practices, plug financial leaks, and introduce digital innovations have etched an indelible legacy within the Commission, serving as a standard for others to emulate.

This narrative serves as a poignant reminder that, in our ever-changing world, embracing innovation and upholding accountability have the potential to usher in lasting positive change. (Flowerbudnews):

  • Garba Abubakar Esq, The Most Effective and Most Productive Registrar General Ever at CAC

Garba Abubakar Esq, The Most Effective and Most Productive Registrar General Ever at CAC

    By Femi Oyekola

Abuja (Flowerbudnews): He was the most effective and most productive Registrar General ever. He was at the Commission as a staff before he was appointed as RG, so he knew their thieving ways and blocked most of them.

He also had a running battle with the the workers’ union, AUCPTRE. There were complaints against their Exco by these same “mourning” staff that they had embezzled the union money, mismanaged their mortgage payments and their cooperative funds.

Since he too rose through the ranks, he knew some or most of the allegations were true but there is this principle of non interference or so in Labour practice which does not allow management to dabble into affairs of workers union. So, what he did was to transfer some of the so called Executives from the headquarters to the States.

They resisted the transfer citing their involvement in labour as excuse. Then the management responded that the Union, AUCPTRE, was a junior staff union by the express provisions of Trade Unions Act and these so called Exco members were senior staff by the records of the Commission and could not be members of that Union, not to talk of being in the Exco.

The Union went to court against the RG and the Commission and we represented them – RG and the Commission.

It was so shocking that they made their case around the fact that the RG had once queried the Exco members in respect of mismanagement of the items I had earlier listed and they refused to answer the query on the ground of breach of the said principle of non interference.

That their transfer was in continuance of interfering in their union affairs. Of course, our defence was that these fellows could not be members of that union and that their case was based on illegal cause since membership of the union had been stipulated by law to be junior staff and these were senior staff in express contrast to the law.

We were also of the position that even if the so called Exco members who were senior staff were to be treated as exceptions to the law, that the non interference should be both ways; that in as much as the management cannot interfere with the union affairs, the Union too cannot interfere with management.

That the management knew where it needed the services of her staffers who more so, were not members of the Union by operations of the law.

We also posited that the affected the individual employees whose interests were personal and who could challenge or pursue their interests using the mechanisms of the Commission. In other words, we challenged the locus of the Union.

We went before the President of the NIC who went to town in showing how abusive he could be.

He abused the living daylight out of the RG and their lawyers for not knowing the basics of Labour Principles, Law and Practice.

He granted the prayers of the Union and declared the transfer of her members (who were not before the court) invalid.

It was my first time before that President of the NIC but I later got to know that he treats what he calls “Labour Practice” like rocket science and always too quick to allege ignorance of that area of endeavour even where such constitutes an affront to common sense, law and even the Constitution.

I know that one day the members of staff of NIC JUSAN or any Unions they have there will also produce an almanac or banners to celebrate his own exit too from that NIC.

The man’s tenure was really revolutionary. Quick service delivery, excellent feedback mechanism. If it is the desire of CAC staff to go back to the old regime, good luck to them and our country.

It’s unfortunate , He was a selfless leader who did his best for the Commission.

He cleared the billions of debts that he met and turned the prosperity of the Commission around.

We can’t be loved or like by all.

We pray for greater blessings for him in his future endeavours.

2008 to 2021, staff were not going on overseas training except the Directors above, he restored that, brought onboard so many innovations that improved our services.

That was part of msgs a friend of mine received from the director

HR…..our people don’t like good public servants. So someone has to be careful about messages on social media.

Definitely it seems he stepped on some toes that want a rotten system who are now trying to get back at him (Flowerbudnews)

  • Nigerian Commends Alhaji Garba Abubakar for Modernising CAC Operations With Technology

Nigerian Commends Alhaji Garba Abubakar for Modernising CAC Operations With Technology

    By Biola Lawal

Abuja (Flowerbudnews):  Alhaji Garba Abubakar, the immediate past Registrar General of the Corporate Affairs Commission CAC) has been commended for Modernising the operations of the Commission to the satisfaction of its customers.

A Lawyer, Barrister Sylvester Udemezue gave the commendation in a public comment he wrote on the tenure of  Alhaji Abubakar as the Chief Executive Officer of CAC, a copy of which was made available to Flowerbudnews on Monday in Abuja.

Barr  Udemezue noted that Alhaji Abubakar successful implemented the Federal Government’s ease of doing business policy to transform CAC operations with deployment of effective ICT technology.

He wrote:  A. G. ABUBAKAR, ESQ came in as the Registrar-General of the Corporate Affairs Commission, and practically deployed ICT-system that radically transformed the whole face of the CAC.

He made doing legal business at CAC stress-free or less stresssful. Before A. G. ABUBAKAR came on board, lawyers could spend up to 3-4 weeks just to reserve a name for company or business-name registration at CAC.

And one had, THEN, to personally be at the CAC office, and experiencing all manner of bottlenecks plus atrocious extortions and by some CAC officials before one’s legal job could be attended to.

The process of registration of company could, THEN, last up to 3-4 months before the arrival of A.G. ABUBAKAR as the RG of CAC.

Now, A. G. ABUBAKAR installed ease-of-doing business; for the past almost 4 years he was at CAC as the RG, No more delays.

    No more hassles!
    No more extortions!

The entire process of registration of a company (from application for approval and reservation of name up to conclusion, and then collection of Certificate of Incorporation) does not last beyond SEVEN (7) DAYS (I mean seven days!!!!) unless the applicant has not fulfilled necessary conditions-precedent to registration of his company or business name.

Besides, NOW, one could from one’s bedroom, start and finish the whole process of incorporation of a company, and within one week.

One can now start and finish any legal job at CAC, from one’s bedroom, without any reasons whatsoever to personally or physically visit the CAC office.

YET, the same man is removed and some lawyers suddenly start protesting to celebrate his removal. Unthinking, undiscerning, brainless brownnosers.

Lawyers are a greater part of the problems of Nigeria!!!!!* From his strides at the CAC, A.G. ABUBAKAR is among the few to have made outstanding strides in public office in Nigeria.

Those castigating him are mostly sponsored by the few disgruntled, corrupt CAC staffers whose corrupt, extortionist tendencies had been halted, and shut out by A.G. ABUBAKAR’s ICT-driven 21st-century innovativeness at the CAC.My opinion, with due respect, Barrister Udemezue concluded (Flowerbudnews)

  • Lawyer Showers Encomiums on Fmr. CAC Registrar General, Alhaji Garba Abubakar

Lawyer Showers Encomiums on Fmr. CAC Registrar General, Alhaji Garba Abubakar

Abuja (Flowerbudnews):  A lawyer, Barr.  Sylvester Udemezue has commended the immediate past Registrar General of the Corporate Affairs Commission, (CAC), Alhaji Garba Abubakar for his outstanding achievements as CAC Boss.

In a message titled; ”THANK YOU, A.G. ABUBAKAR, ESQ (IMMEDIATE PAST REGISTRAR-GENERAL OF THE CORPORATE AFFAIRS COMMISSION) FOR ACHIEVING WHAT CLUELESS LEADERS OF THE LEGAL PROFESSION (BAR AND BENCH) COULDN NOT ACHIEVE”,  Udemesue recalled the tremendous landmarks of Alhaji Abubakar as CAC Boss.

    Full Statement below:

    ——–

    By Sylvester Udemezue

Fellow Nigerians, we all know the Herculean hurdles one had to go through to get a company registered in Nigeria.

The experience was harrowing. Remembering it is saddening. But A.G. ABUBAKAR, ESQ took over at the CAC and transformed the institution and pulled it away from the doldrums of archaism, from the clutches of obsolescence and from the prescints of leadership cluelessness.

🅰️. Check out what the situation then became, and until today, under A. G. ABUBAKAR, ESQ:
From a fueling Station in Benin City, Edo State, with my smart phone, on a Sunday afternoon, I had begun and concluded *the process of appling for search and reservation of a company name*

I thereafter had a meeting in Benin, after which I proceeded to Yenagoa, Bayelsa State, the following morning.

2️⃣. Upon my arrival in Yenagoa, I opened my account with the CAC and saw that the a name had been approved and reserved for my client.

3️⃣. Then, later that day from a restaurant where I had gone to eat OPRU-FLO Soup (my favourite soup in Yenagoa), I started and concluded the process of application for registration of the proposed company, uploading all necessary information and documents and making necessary payments.

That was a Monday afternoon. By Wednesday morning of the same week, the process of incorporation was already completed with all necessary documents (including the Incorporation Certificate) delivered to my account, which I logged into and downloaded them and sent to my client in Lagos.

🅱️. On the other hand, final judgment in a suit arising from an argument between a tenant and a landlord [see PILLARS V DESBORDES (2021)], was finally delivered in November 2021 after the case (which began in the Lagos High Court) had lasted about 29 (twenty-nine) years in Court. PILLARS V DESBORDES is not an isolated case; in Nigeria, on the average, a lawsuit lasts at least 6-17 years at the Court of first instance, then between 5-10 years at the court of Appeal, and finally between 8-20 years at the Supreme Court of Nigeria before final determination. On the whole, a lawsuit in Nigeria takes a minimum of 20-40 years to get finally determined..

Towards reddressing the ugly situation, the CJN (Chief Justice of Nigeria) has achieved NOTHING; the CJ of the FHC has achieved NOTHING; CJ’S of the various states are busy making and amending Rules of Court which achieve ZERO; tje PCA (Presido of the court of appeal) has achieved NOTHING.

Indeed, in the Legal Profession in Nigeria, leaders have achieved NOTHING.*Leaders of Nigeria’s legal profession are custodians of incompetence — NBA (national and branches), BOSAN, LPRC, LPDC, GCB, BOB, NJC, FJSC, S-JSC, Judiciary, etc.* We are running an incompetent system in the legal profession, and thereby endangering the present and the future of our nation.

*◾It takes only people who are doing well to recognize someone who is doing well.* The campaign of calumny against the immediate past REGISTRAR-GENERAL of the CAC, A. G. ABUBAKAR, ESQ, is being waged by faceless lawyers who are being sponsored by the same leaders who are the reasons the legal profession is down and stagnant.

They’re pained that A.G. ABUBAKAR, ESQ has moved the CAC out of the doldrums of archaism, myopia, obsolescence, cluelessness, unpragmatism and incompetence.

Thank you, A.G. ABUBAKAR for the indelible marks you have left at the CAC, proving to all in the legal profession, that it’s not impossible to use ICT to transform the way we do things so that we can join the modern world and operate in line with prevailing 21-century benchmarks and global best practices. Before you came on board at the CAC, company registration was done MANUALLY, and could take up to three-four months to conclude.

Today, as you exit the seat of the RG of the CAC, company registration could be started from the scratch and concluded within 3-7 days.*

Thank, A.G. ABUBAKAR . It’s your type that should be CJN, PCA, CJ, NBA president, LPRC chairman, LPRC Chairman, Attorney-General, so that you can help us achieve the same type of transformation into modernity, that you achieved at CAC. We need you everywhere to change everything.

Look at the dilapidated state of the legal profession:
    1️⃣. No enforceable charging standard in the Nigerian Legal Profession;
2️⃣. Justice Delivery in Nigeria maintains its lead as the slowest, the most indolent, the most corrupt, the most archaic, the most outdated, the most confused, the most subservient, the most ineffective and the most fruitless in the world
3️⃣. Judiciary leaders, from the CJN to the PCA, CJ’s and Presidents of both the NICN, CCA, to the Chief Magistrates are just there doing absolutely nothing but collecting salaries and allowances and waiting for retirement to collect between N2 billion and N3 billion as terminal benefits.
▪️Even tomato sellers association are more organized, innovative and pragmatic than leaders of the legal profession.
▪️Even *Lagos, Agberos, Louts, Touts, and Area-Boys Organization* are more coordinated, and innovative than leaders of the legal profession in Nigeria.

Sir, I am not saying you are perfect as a leader, but that you’re an innovator, pragmatic, sagastic, and an achiever.

See for example the promise made by the current CJN upon his confirmation:

_”I shall not let Nigerians down …we shall not fail Nigerians. *We shall make progress and advance the judiciary of Nigeria to benefit, not only the common man, all men and women.* We are *computerizing the Supreme Court already, and all other courts of records.* So, that the delay in filing cases will become a thing of the past. *

We’re creating e-filing, we are creating e-diary* so that lawyers can stay in the comfort of their chambers and contact the court, and address the court via zoom. Computerization is already taking place, not only in the Supreme Court, the Court of Appeal and other courts of record in Nigeria.”_

Source: *”Buhari swears in Ariwoola in as substantive CJN”* October 12, 2022
<https://tribuneonlineng.com/buhari-swears-in-ariwoola-in-as-substantive-cjn/>. Indeed, it was with high hopes, that *CJN Olykayode Arowoola* was sworn in, and he immediately promised giant strides and swift reforms to uplift the judiciary. See: *”New CJN, Ariwoola Promises Reforms to Promote Justice”* <https://m.youtube.com/watch?v=y4SL-ioYd_c>. Today, nothing. Absolutely nothing!!!! No innovation. No achievements other than getting involved from one controversy after another.

*Perhaps, he has forgotten his promises, or the promises were empty!!* He has been in office since 2021, when he succeeded *my Lord, Justice Tanko Muhammad , CJN,* who had achieved absolute zero! The story is the same with NBA leaders, LPRC leaders, LPDC members, GCB leaders, BOB leaders, NJC leaders, FJSC leaders, BOSAN leaders, etc.
    ▪️Zero achievements everywhere.
    ▪️Zero innovations.
    ▪️ Zero pragmatism.
    ▪️Zero foresight.
    Just grandstanding and shenanigans

Thank you A. G. ABUBAKAR for showing that purposeful and fruitful leadership is possible in Nigeria. I know some lawyers and leaders of the legal profession who hate you, are spreading all manner of evil propaganda and outright lies against you. Don’t worry, it is because you are ahead of them in innovation, in pragmatism, in sagacism, and in foresight. You are an achiever, unlike they. They have nothing to show for their leadership of any sector of the legal profession. So, don’t mind them.

I wish you the best in your future endeavors. I am praying for more, higher leadership opportunities for you to continue to impact positively upon humanity. Amen🙏

    Respectfully,*Sylvester Udemezue (Udems)* 08109024556. mrudems@yahoo.com. (Flowerbudnews)

Jurisdictions of Labour Unions;  More Govt. Agencies Set to Implement Appeal Court Judgement

    By Biola Lawal
Abuja (Flowerbudnews)  Following the landmark judgement recently issued by the Court of Appeal on the jurisdiction of labour unions in the country, more government agencies are set to implement the provisions of the judgement.

The latest among such agencies is the Industrial Training Fund (ITF).

Abdullahi Ibrahim Tsoho, Head of Industrial Relations, Staff Welfare, and Career Development at the ITF, revealed this on Friday during a visit to the Corporate Affairs Commission (CAC).

Abdullahi Tsoho, who led a delegation from the ITF, stressed that they were in the commission to leverage its experience with a view to implementing the recent pronouncement of the court of appeal.

The delegation was jointly received by the Director of Human Resources, Olayemi Oyeniyi, and the CAC SSASCGOC President, Comrade Suleiman Girei, in the company of some executive members.

Olayemi Oyeniyi spoke on the Commission’s approach to ensuring effective management of labour relations.

For his part, Comrade Suleiman Girei recalled the circumstances that led to their victory at the court of appeal and pledged that SSASCGOC would continue to operate on the principles of dialogue and mutual respect to settle industrial disputes.

CAC News reports that also on the visiting delegation to the Commission
was Geoffrey Semnoe legal officer at the ITF.

It would be recalled that the Court of Appeal had on Friday, July 28, 2023, held that SSASCGOC reserved the right to unionise Senior Staff from Level 7 and above in all Statutory Corporations and government-owned companies, while AUPCTRE can only unionise junior staff from Level 6 downwards as provided by the Labour laws.

The judgement was the aftermath of an appeal instituted by the AMALGAMATED UNION OF PUBLIC CORPORATIONS CIVIL SERVICE TECHNICAL AND RECREATIONAL
SERVICE EMPLOYERS (AUPCTRE) against the SENIOR STAFF ASSOCIATION OF STATUTORY
    CORPORATIONS AND GOVERNMENT OWNED COMPANIES(SSASCGOC).

The appeal was against the judgement of the National Industrial Court sitting in Abuja in Suit No. NICN/ABJ/125/2019 delivered on December 17, 2019 by Hon. Justice O.Y. Anuwe.

The notice of appeal which was filed on December 20, 2019, contained six grounds of appeal.

CAC News reports that Justices of the Court of Appeal UGOCHUKWU, Anthony OGAKWU, Mohammed Mustapha, and James Gambo Abundaga all consented to the landmark judgement, which put to rest the arguments surrounding the jurisdictions of the two Unions. (Flowerbudnews)
