    AMML boardroom crisis: Lawyer urges Wike to respect court judgments, orders

     

     

    Abuja:  A lawyer, Faruk Khamagam, has called on the Minister of Federal Capital Territory (FCT), Nyesom Wike, to respect court judgments and orders affirming Alhaji Faruk Abubakar as the valid managing director (MD) of Abuja Markets Management Limited (AMML).

    Khamagam, who was Abubakar’s counsel, made the call on Friday at a press briefing in Abuja.
    He said the minister, who is not just a lawyer but a life bencher, ought to respect judgments and orders coming from the same bench he is a member of in the interest of the integrity of the judiciary and the rule of law.”

    He reminded that an Abuja Federal High Court (FHC) and National Industrial Court (NIC) had, at various occasions, decided on the controversy surrounding the headship of the AMML to the favour of his client.

    The lawyer restated that a FHC in suit number: FHC/ABJ/CS/499/2023, on July 10, reaffirmed Abubakar as the authentic MD of the company besides an NIC judgement in suit marked: NICN/ABJ/62/2023 which also validated Abubakar’s position as the valid and substantive MD and chief executive officer of AMML.

    Khamagam equally reminded that following the purported meeting of July 17 wherein Abubakar was removed as MD, he said the same NIC, on July 26, made an interim order, restraining the defendants, including the FCT minister, from giving effect whatsoever to the purported removal.

    “However, despite the subsistence of these judgments and orders, subsequent events have shown total disregard and lack of respect for the judiciary and judicial processes on the parts of FCT Minister, FCT General Counsel, and their foot soldiers including but not limited to Mohammed Abbas Yakubu, the Commissioner of Police FCT, among others,” he said.

    He said to set the record straight, “our client remains the valid, substantive and authentic managing director and chief executive officer of the AMML, based on the valid and subsisting” judgments and order of the courts.(NAN)(www.nannews.ng)/ Flowerbudnews

    Agency leadership dissolution: Court begins contempt proceedings against Wike, others

     

     

    Abuja:  A National Industrial Court in Abuja on Wednesday began has a contempt proceedings against FCT Minister, Nyesom Wike, and others over alleged disregard of series of court orders.

    The court affirmed Alhaji Faruk Abubakar as Managing Director and Chief Executive Officer of the Abuja Markets Management Limited (AMML).

    The development was sequel to the decision of the minister to include AMML’s MD in the list of heads of agencies dissolved on Sept. 27.

    The News Agency of Nigeria (NAN) reports that Wike had, on Sept. 27 in a statement, relieved the heads of 21 parastatals, agencies and government companies of the Federal Capital Territory Administration (FCTA) of their appointments with immediate effect, including AMML.

    The contempt charge, filed by Alhaji Abubakar also joined FCTA, AMML and Abuja Investments Company Limited (AICL) as 2nd to 4th defendants respectively, including the former acting MD of AMML, Engr. Yakubu Abbas.

    In the Form 48 marked: NICN/ABJ/62/2023 dated and filed on Nov. 3, the application was titled: “Notice of Consequences of Disobedience to Order of Court.”

    It was brought pursuant to Section 72 Sheriff and Civil Process Act, 2004; Order IX Rules 1-3 of the Judgment Enforcement Rules and Under the inherent jurisdiction of court.

    The application reads: “Take notice that unless you (the defendants) obey the orders and directions contained in the judgment of court on July 20 and the order of this Honourable Court made on July 26, you will be guilty of the contempt of court and will be liable to be committed to prison.”

    NAN reports that Abubakar’s counsel, Faruk Khamagam, had, following the dissolution, written to Wike on Sept. 28, to inform him about the peculiar situations that surrounded the agency’s headship and the legal tussle that preceded his appointment as minister.

    Khamagam, in the letter, told Wike series of court judgments that affirmed Abubakar’s status as substantive MD of AMML.

    The contempt proceeding was against the allegation that the minister and others are acting in disobedience to the orders of the industrial court made on July 20, restraining them from giving effect to the purported letter of termination of the employment of Abubakar as the AMML’s MD.

    Justice R.B.Haastrup had restrained the defendants from giving effect to the termination of the employment of Abubakar Usman Faruk as the M.D of AMML, which was contained in their letter dated July 17 until the hearing and determination of the counterpart motion on notice.

    The judge also ordered the defendants not to,in any way, interfere in the management, business and corporate affairs of the AMML and that status quo ante be maintained until the counterpart motion on notice was heard and determined.

    NAN also reports that Justice Donatus Okorowo of a Federal High Court, Abuja, had, on July 10 in a judgment, restrained the FCT Minister, the FCTA and others in the suit marked: FHC/ABJ/CS/499/2023 from dissolving and reconstituting the Board of AMML by political fiat or press statement, without first following the procedure of CAMA, 2020.

    The court declared that doing so is ultra vires the powers of the FCT Minister and the FCTA.

    The court also affirmed Abubakar as AMML’s MD.

    Khamagam, who said the AICL and FCTA had continued to insist on the termination of Abubakar’s employment as contained in their July 17 letter, also said that Abbas had been parading himself as AMML acting MD against valid court orders and judgment.

    “Engr. Yakubu Abbas himself, has been parading himself as the acting MD of AMML and has been signing and issuing documents in that capacity, in the name of AMML from unknown locations,” he alleged.

    The AMML Legal Adviser and Secretary, Mr Felix Edache, also alleged that on Monday, the policemen from various commands stormed AMML head office in Gudu on the order of the FCT commissioner of Police.

    Edache said the officers, led by DSP Bello Adamu, said they were deployed to ensure peace and workers’ safety.

    “When I resumed, I saw a flood of armed policemen all over the premises.

    “Upon getting to the office, I was told that they had come to ensure safety of the place but I told them that I am not aware that AMML made any complaint to the police to that effect.

    “In fact if there should be any of such complaint, it should have come from me,” he said.

    According to him, the real agenda unfolded later in the evening when they provided a memo from the FCTA signed by the General Counsel, Salman Dako, purportedly written on behalf of the FCT Minister asking the CP to prevent the MD, Abubakar, and the Legal Adviser from gaining entrance into the office.

    “Although, the memo by Dako cited the termination of Abubakar’s employment as the eason for the request, it did not say why the police is being asked to prevent me from entering the office.

    “We are law abiding citizens. We will never do anything to subvert the law.

    “However, any attempt to trample our right would be resisted with every legal tool.

    “It is time for the Minister to reassess his legal team at the ministry so that they don’t end up misleading him into running foul of the law which he also swore to protect as both lawyer and public servant.

    Last week the political space of Rivers State was again shaken by a rash desire underscored by crash emotions and action to impeach the democratically elected Governor of the State – H. E Sir Siminalayi FUBARA (GSSR )

    The fallout led to the burning of the House of Assembly chambers by ardent political supporters. ln the ensuing drama, actions were swiftly taken to arrest the tide.

    The Speaker( Rt. Hon Martins Chike Amaewhule) was impeached and a new Speaker (Rt. Hon Edison Ehie) elected, the COS to the Governor, Mr. Chidi Amadi was equally given the boot!

    Things were moving faster than the speed of light; the chief Judge commissioners and 23 Local Government Area Chairmen may not be spared.

    Though the Commissioner of information and communication, Mr Warisenibo Joseph Johnson has dispelled the further sacking of any government official

    Addressing supporters earlier at the House of Assembly Complex on Monday where he had gone to assess the damage done to the burnt chambers, the governor visibly calm, had said he had not committed any impeachable offence offering to talk to the press at a later time.

    Perhaps Fubara’s perceived offence was the recent appointment of Commissioners which political observers said was without Wike’s input having exhausted his recommendations.

    Others say various monetary demand brought about the love lost

    It is shamefully noteworthy that the Governor, the No1 Chief Security Officer of the state was equally attacked, shot at by the police drafted to the complex to keep law and order.

    The Governor, we are told only escaped by the whiskers as a large following shielded him off teargas cannisters and more.

    In this regard, Lious Edet House has confirmed the incident and vows to deal with anyone found culpable as investigation is underway.

    Having failed in their plan A action, in the coming days may shift to rendering the state ungovernable if Wike is allowed to go full swing with his allies. The idea is to attract President Tinubu whose ears Wike has to imposing a state of emergency on Rivers State in their permutations for 2027  regardless of the President’s surgical intervention.

    it’s left to be seen in the light of the permutations on ground. Meanwhile the two Rivers sons have were said to have met behind closed doors in Abuja. They shook hands upon meeting enroute the Police Council meeting chaired by Mr President The last was in 2021

    It’s not clear if the path to peace and less control of the state affairs will be brokered.

    The path of honour for Wike would have been dialoguing, advising and providing guidance for a Government he painstakingly entrenched. Wike can afford to show fartherly courage and go tete-a-tete with the Governor!

    For making the Riverine region to govern in 24 years of the life span of the state, Wike had already written his name in kandahar. why sacrifice it on the alter of ego ?

    whatever the disagreement is, a disagreement where Impeachment of the Governor is to be secretly executed is no more a mere disagreement.

    From Ada George to Peter Odill, Omeha, Amaechi to Wike, no one made an Impeachment attempt on the other or assassination attempt. lt can’t be recalled that any Impeachment moves in the 8years of Wike’s administration as govervor. You dare not!

    The powers right now rest with the Governor. Let there be father/Son like dialogue . State of emergency as plan B will not work. The price is far more. Let the issues which are more than meets the eye be resolved amicably.

    To pupetize the Governor is not in the best interest of a party who wants to deliver dividends of democracy.

    The coming days will redefine governance as Governor Siminalayi FUBARA is expected to deepen his grip and ensure the bridge to youths and more -people oriented governance is not truncated.

    FCTA, Israel to partner on agriculture, security, digital economy

    Abuja:  The Minister of the Federal Capital Territory (FCT), Nyesom Wike, says the FCT Administration will partner with the State of Israel on agriculture, security, and digital economy.

    Wike stated this when he received the Israeli Ambassador to Nigeria, Mr Michael Freeman, in his office in Abuja on Tuesday.

    He expressed a commitment to partner with Israel on information technology, particularly in the development of the planned Technology Village in Abuja.

    The minister added that the climatic condition of Abuja city is also conducive for agricultural production.

    “The climate here is good for agriculture, so I would like to partner with you to have a large technology driven farm to employ a lot of our youths.

    “It will be good if you can open that channel,” he said.

    Wike also called for partnership to improve the security situation in the FCT, stressing that security was very crucial to enable people to do their businesses without fear.

    “Let us work together to help us reduce some of the insecurity in FCT,” he added.

    Earlier, Freeman offered to support the FCT minister in making Abuja a technology hub using Israeli expertise.

    He said that currently when people think about technology, Lagos always comes to mind, stressing the need to work together to build a technology-driven economy in the federal capital.

    “I want to discuss with your team on using Israeli expertise to set up centres where people can learn about digital economy and build digital start-ups.

    “We will also be glad to work with you on agriculture in Nigeria to provide jobs. We will also work with you on digital economy, alternative energy and security.

    “There are huge opportunities for us to work on,” he said.

    The ambassador invited the minister to visit Israel to discuss opportunities that could benefit all parties. (NAN/ Flowerbudnews

    Abuja:  The Minister of the Federal Capital Territory (FCT), Mr Nyesom Wike, has sacked heads of 21 parastatals, agencies and government companies of the FCT Administration.

    Mr Anthony Ogunleye, Director of Press, Office of the Minister, disclosed this in a press statement in Abuja on Wednesday.

    Ogunleye identified the affected heads of the agencies as follows:

    1. Group Managing Director and Chief Executive Officer (CEO), Abuja Investment Company Ltd

    2. CEO/Managing Directory, Abuja Markets Management Ltd

    3. MD/CEO, Abuja Urban Mass Transport Company

    4. CEO/MD, Abuja Property Development Company
