    Supreme Court upholds election of Gov Abiodun of Ogun State

    The Supreme Court, on Friday, upheld the re-election of Governor Dapo Abiodun of Ogun State.

    apex court, in a unanimous decision by a five-member panel, dismissed as lacking in merit an appeal the Peoples Democratic Party, PDP, and its candidate, Ladi Adebutu, filed to challenge the outcome of the governorship poll held in the state on March 18, 2023.

     

    In its lead judgement that was prepared by Justice Tijjani Abubakar, the apex court said it found no reason to nullify the election victory of Governor Abiodun, who was the candidate of the All Progressives Congress, APC.

     

    The apex court upheld the earlier verdict of the Court of Appeal, which on November 22, 2023, dismissed the case the PDP and its candidate raised against the election.

     

    “This appeal is unmeritorious, and it is accordingly dismissed,” the court held.

     

    The Independent National Electoral Commission, INEC, had declared that Governor Abiodun polled a total of 276,298 votes to defeat his closest rival, Adebutu of the PDP, who garnered a total of 262,383 votes.

     

    Dissatisfied with the outcome of the poll, Adebutu approached the Ogun State Governorship Election Petitions Tribunal, insisting that he was the valid winner of the gubernatorial contest.

     

    He, among other things, alleged that the election was not conducted in substantial compliance with provisions of the Electoral Act 2022.

     

    Aside from alleging that the election was marred by irregularities and corrupt practices, Adebutu alleged that over 40,000 voters from his strongholds were disenfranchised due to violence.

     

    He told the tribunal that he secured the highest number of valid votes cast at the election and therefore ought to have been declared the winner by INEC.

     

    However, Adebutu’s petition was dismissed by Justice Hamidu Kunaza, who led a three-man tribunal that affirmed Abiodun as the bona fide winner of the contest.

     

    Likewise, the Lagos Division of the Court of Appeal, on November 24, 2023, in a split judgement of two to three, upheld the decision of the tribunal.

     

    While the appellate court, in its majority decision that was delivered by Justice Joseph Ikyegh, found no reason to dislodge the judgement of the tribunal, in her minority verdict, Justice Jane Inyang directed INEC to withdraw the Certificate of Return it issued to Abiodun and, within 90 days, conduct a fresh election in some polling units in the state.

     

    Whereas Adebutu approached the Supreme Court to challenge the appellate court’s majority judgement, Governor Abiodun lodged a cross-appeal to set aside the minority verdict that ordered the fresh election.

     

    INEC equally lodged a cross-appeal, praying to the Supreme Court to validate the result of the election that it announced.

    Katsina:  Gov. Dikko Radda of Katsina State has approved the allocation of 25 hectares of land to the Federal Government for the construction of 500 houses in the state.

    Malam Ibrahim Kaula, the Chief Press Secretary to the governor, said in a statement in Katsina on Friday that the land is located close to the Umaru Musa Yar’adua University, Katsina.

    He said the approval was conveyed to the Minister of Housing and Urban Development, Alhaji Ahmed Musa-Dangiwa, by the Commissioner for Lands and Survey, Dr Faisal Kaita, on Thursday in Abuja.

    Kaula said the gesture was part of the resolve of the state to collaborate with federal authorities for the development of the state.

    He explained the Federal Government’s Renewed Hope City Project, unveiled in Oct. 2023, aims at constructing vibrant housing communities across the country.

    “The project comprises approximately 1,000 housing units in each state and 4,000 units in the Federal Capital Territory (FCT).

    “This initiative aligns with the Renewed Hope Agenda of President Bola Tinubu, specifically in addressing housing and urban development,” he said.

    Kaula said that following the project’s unveiling, the ministry sent land allocation requests to every state, seeking a minimum of a single 50 hectares of land or two separate 25 hectares in close proximity to the state capital.

    He said that the strategic allocation was crucial to the successful realisation of the renewed hope city project.

    The governor’s spokesman added that the collaboration underscores the commitment of the state to supporting the national initiative of providing affordable housing solutions, thus contributing to national development. (NAN)/ Flowerbudnews

    Nigeria bounced into reckoning at the 34th Africa Cup of Nations with a lone-goal victory over hosts Cote d’Ivoire at the Stade Olympique Alassane Ouattara on Sunday.

    The win was enough to pick up three valuable points and push the Elephants down to third place.

    Before kick-off, both teams knew they had much to do as defeat would take steam out of either team’s campaign, following Equatorial Guinea’s manful 4-2 defeat of Guinea Bissau’s Wild Dogs earlier in the day at the same venue.

    Nigeria was most pressed to turn up with the goods having only drawn with Equatorial Guinea’s Thunder in their first match on Sunday.

    They were not shy to make their intention known, only that Victor Osimhen heaved over the bar from a great pass by Samuel Chukwueze in the 8th minute.

    In an early warning that it would be the end-to-end encounter it turned out to be, the Eagles were in an anxious moment a minute later, but goalkeeper Stanley Nwabali was on hand to deflect to corner after Zaidu Sanusi’s weird header put the defence under pressure.

    On the quarter-hour, Nwabali had to be alert as the Ivorians swept on the Eagles’ rear and Ibrahima Sangare fired towards goal.

    Eight minutes later, William Ekong checkmated an Ivorian onslaught, and at the other end, Samuel Chukwueze was checkmated by Ousmane Diomande.

    In the 31st minute, Nwabali saved from Seko Fofana and the rebound was wasted by the Elephants.

    Nine minutes into the second half, referee Mustapha Ghorbal’s attention was drawn by the Video Assistant Referee to a foul on Africa Player of the Year Osimhen by Diomande in the Ivorian box.

    It was a penalty to Nigeria, and on-field captain William Ekong, who has provided much-needed stability to the Nigerian defence at this tournament, stepped up with assurance and blasted it past goalkeeper Yahia Fofana into the net.

    Sangare, Seko Fofana, Franck Kessie, Jeremie Boga, Christian Kouakou Kouame and Jean-Philippe Krasso all tried their best to put the Elephants back into the game, but the Ekong-led Nigeria defence remained impenetrable.

    Chukwueze and substitute Bright Osayi-Samuel had gilt-edged opportunities to extend Nigeria’s lead but bungled things, and in the 73rd minute, Nwabali was again on the alert to foil an onslaught by the Elephants.

     

    Victory took the Super Eagles to joint-first in group A, only behind Equatorial Guinea on goal difference, while the Elephants sank to third position and must beat Thunder on Monday to guarantee a place in the Round of 16.

    On the same day, the Super Eagles will take on the Wild Dogs of Guinea Bissau, needing only a point to be assured of a place in the Round of 16. (Flowerbudnews)

    Abuja:  The Director-General of the National Identity Management Commission (NIMC), Abisoye Coker-Odusote says NIMC and the Nigerian Communications Commission (NCC) are collaborating with security agencies to track down kidnappers and rescue the victims.

    The NIMC boss spoke at the Stakeholders Consultation Forum in Nigeria Digital Identification for Development Project (NDID4D) on Thursday, in Abuja.

    Odusote said they were going to use the National Identity Numbers (NIN) and Subscribers Identity Modules (SIM) databases to track them down.

    The News Agency of Nigeria (NAN) reports that the forum is with the theme, “Fostering Inclusion and Feedback Mechanism in the Nigeria Digital (ID4D) Project.”

    Odusote declined to give details of the collaboration, saying some gaps had been identified and all stakeholders were working to close up such gaps to address the security problems plaguing the country.

    She said loopholes that had been identified were being plugged, while NIMC and NCC were also collaborating with security agencies to ensure infrastructure and other necessary information were harnessed to address the challenges.

    Odusote, represented by her Technical Assistant, Mrs Ayobami Abiola, said that the essence of NIN for citizens was to reduce incidences of corruption and implement strategic development plans.

    According to her, countries that have completed their national identity databases have been able to deploy them for development and implement social security programmes successfully.

    Odusote said that NIMC would strengthen relationships with key stakeholders to ensure that established functional structures across states, local government, ward, and community levels could make enrolment for NIN more accessible to the people.

    She said that more vulnerable persons, especially persons with disabilities, as well as people who were in various Internally Displaced Persons (IDPs) camps in the country, would be captured in the National Identity Database.

    She said President Bola Tinubu had expressed concerns about fragmented identity and the need for Nigeria to have a unified system, saying the administration was committed to changing the narratives of national identity for all Nigerians.

    “The President has expressed worry over our fragmented identity system, which is causing the country huge losses in expenditure and has given us marching orders to ensure we integrate and unify our identity system.

    “To match words with action, the President on assumption of office as Commander-in-Chief signed the Nigeria Data Protection Bill, now Nigeria Data Protection Act.

    “This was to provide the needed legal framework for the protection and privacy of the data of Nigerians and legal residents.

    “The NIN is free and for everyone. At the NIMC, we frown at all forms of extortion and will ensure anyone found culpable of extorting any potential enrollee is made to bear the full weight of the law.

    “Since my assumption of office as the D-G of NIMC, I have led several sting operations to enrolment and regional coordination centres across the country.

    “Some of our staff who were found extorting enrollees were handed over to law enforcement agents for prosecution.”

    Odusote explained aside from working to remove all impediments and barriers to enrolment for a national ID, NIMC was working closely with the NDID4 with support from the World Bank,

    Others are French Development Agency (AFD), and European Investment Bank (EIB) in implementing series of sustainable and innovative reforms among others.

    “The goal is to remove all current challenges and difficulties that people face in enrolling for IDs, fostering a robust, seamless, and more inclusive enrolment system where ID is provided for everyone, and no one is left behind.

    “We are also committed to addressing the challenges and barriers that vulnerable individuals and groups, including women, persons with disabilities, IDPs and refugees face in obtaining the NIN.

    “It is needed to facilitate their access to critical services necessary for their well-being.

    “NIMC is fashioning ways to clear the backlog of enrolment fees owed to enrolment partners.

    “It has also developed a robust business model to incentivise all partners particularly those who will be conducting enrolment in remote and hard-to-reach communities and locations.”

    She said that over 300 representatives of the revalidated enrolment agents drawn from every part of Nigeria, were undergoing training on several aspects of the enrolment process.

    “This is to equip them with all necessary skills and information needed to help them interact well with applicants and integrate into communities they are commissioned to carry out enrolment.

    “We will be working on amending the NIMC Act to ensure it is in consonance with the current digital realities to ease integration with other foundational ID agencies like the National Population Commission.

    “We are also working tirelessly on upgrading the enrolment software and ensuring the training and retraining of all licensed enrolment partners,” she said.

    Earlier, Solomon Odole, the Project’s Coordinator, NDID4D, stated that the forum was aimed at engaging stakeholders of the reforms that NIMC was making to ensure the NIN enrollment and issuance became easy and seamless for everyone.

    Odole also said the idea behind the forum was to ensure that vulnerable and marginalised individuals and groups were given visibility and adequately considered in the identity system.

    ‘‘This workshop is not just about professional development but also an opportunity to foster meaningful connections and build lasting relationships.

    “The workshop was aimed at fostering collective efforts among various stakeholders to foster a robust and inclusive foundational ID for every Nigerian and legal resident devoid of any form of discrimination or hindrance that ensures their access to services.”

    Abuja:   A Federal High Court, Abuja has fixed Jan. 29 for hearing of a suit filed by seven senior advocates of Nigeria against Gov. Yahaya Bello of Kogi and others over his appointment of judges in the state in violation of extant laws.

    The News Agency of Nigeria (NAN) reports that the suit, which was assigned to Justice James Omotosho, sought a mandatory order restraining the defendants from appointing new judicial officers until there is strict compliance with the laws.

    The aggrieved lawyers, who also hail from Kogi, are Yunus Usman, SAN; Jibrin Okutepa, SAN; Patrick Okolo, SAN; Abdullahi Haruna, SAN; Reuben Atabo, SAN; Shaibu Aruwa, SAN and Johnson Usman, SAN.

    The plaintiffs, in the originating summons marked: FHC/ABJ/CS/05/2024, sued the National Judicial Council (NJC), Kogi State Judicial Service Commission, Governor of Kogi and Attorney-General and Commissioner for Justice in the state as 1st to 4th defendants respectively.

    The suit filed Jan. 11 sought a declaration that the selected candidates, including Mrs Amina Yahaya Bello, the governor’s wife, for onward transmission to NJC for appointment as judges was not “totally based on merits, competence, sound knowledge of the law, professional expertise and skill, seniority, fairness, equity and equality.”

    They argued that the same was marred by political and ethnic influence contrary to the provisions of Rule 3 (6)(i)-(iv) and Rule 4(4)(a) of the NJC Guidelines and Procedural Rules for the Appointment of Judicial Officers of all superior Courts of Records in Nigeria, 2014 and Section 153 of the 1999 Constitution (as amended),
    They said it also contravened Paragraph 21(c) Part I, Paragraph 6 (a) and (b) Part II of the Third Schedule to the Constitution (Supra); as well as Section 14 (4)(a) of the Constitution (Supra), among other reliefs.
    In the affidavit deposed to by Okolo, they averred that two women were shortlisted from Kogi Central and that one of them was Amina, Gov. Bello’s wife.
    They alleged that Amina and other shortlisted candidates did not have the required number of judgments of both trial and appellate courts that qualifies them for appointments as judges of the superior courts of records in Kogi as required by the NJC’s rules.
    They also alleged that the state’s judicial service commission was doing the bidding of the governor.
    The chief judge of the state, in a letter dated Oct 9, 2023 with Reference Number: CJ/S/1/1X/A/355 to the Lokoja Branch of Nigerian Bar Association (NBA) and sighted by NAN, said the list was a provisional shortlist of candidates for the appointment of the 10 judicial officers.
    They were to be appointed into the state’s High Court, Sharia Court of Appeal and Customary Court of Appeal.

    The 29 candidates in the letter include “Badiru Abdulghaniy, Ezema Beatrice, Ibrahim Idenyi, Amina Yahaya Bello, Joseph Sunday Ajesola, Dr. Mohammed Tanko, Badama Kadiri, Umaru Medina, Ibrahim Jubril Oladimeji, Ojoma Rachael Haruna, Zakari Wahab and Halimat Onuka for the High Court of Justice.
    The candidates for the Shari’a Court of Appeal are Idris Abdullahi, Abdulwasiu Salaudeen, Muhammad Bello and Mohammed Agaba.
    Others are Okino Saidu, Abdulaziz Abdulmali, Ganiyu Adeku,. Yakubu Abbas, Hassan Hussaini, Musa Jibreel, Hussaini Labaran, Salihu Abdullahi, Idrees Abdullahi and Shaibu Aliyu.
    Those shortlisted for the Customary Court of Appeal include Musa Onogo Idris, Maryann Oziohu and Shaibu Ozovehe Ebenezer.
    NAN reports that the NJC had suspended the process of the appointment of judges and kadis into the state’s judiciary.

    The council, which said the development was to maintain a fair and just judicial system, took the action following a letter to the NJC by the seven senior lawyers intimating it on a suit instituted against the appointment.(NAN)(www.nannews.ng) /Flowerbudnews

    Enugu: The International Human Rights Observatory Africa (IHRO-Africa) has tasked National Assembly members on accountability and good governance to ensure dividends of democracy get to millions of Nigerians.

    The Special Envoy and Country Director of IHRO-Africa to Nigeria, Dr Chimbo Obieze, gave the task on Thursday in Enugu while speaking on the international group’s interest to monitor activities of lawmakers nationwide.

    Obieze said that before the first quarter of the 2024 runs out, the group would be launching “The Legislators’ Diary”.

    He said that the – “The Legislators’ Diary” – would be an internationally funded programme to promote accountability and good governance by tracking all constituency projects as well as other largess meant for the people.

    According to him, “The Legislators’ Diary” will be a game changer as it will not be business as usual.

    He said: “It will be well funded and even with international funding to ensure the desires of IHRO-Africa floating the programme was achieved.

    “We are going to use our local and international networks to monitor and even block funds meant for the people that are finding their way to foreign countries.

    “IHRO-AFRICA will use The Legislators’ Diary to expose ill-intent legislators and force them to do the needful and right things as it concerns caring and providing what is rightful and due to their constituents.”

    Obieze, however, commended national assembly and state assembly members that are already providing quality representation and declaring what is coming from the Federal and state governments truly to their constituents.

    “IHRO-AFRICA will not fail to commend and encourage lawmakers that are leading by positive examples, care, good governance and dividends of democracy to their constituents.

    “These positive actions are already reducing the rate of hardship and hunger in the country and giving the people a sense of belonging and believe in the country,” he added. (Flowerbudnews)

    London (Flowerbudnews): Michael Musah, the eldest son of Ambassador Abdel-Fatau Musah, ECOWAS Commissioner for Political Affairs, Peace and Security is among more than 5,000 latest graduates of Britain’s leading King’s College, London.

    Michael, who holds a BA in International Relations from the London South Bank University, graduated with a Master’s in International Peace and Security, and distinction in U.S.-China modules.

    His proud parents Ambassador Musah and Audrone Sileryte and well-wishers attended his latest graduation ceremony on Wednesday, part of the university’s week-long convocation programme held at the Royal Festal Hall, in central London.

    She enjoined them to see their certificates as an academic achievement and empowerment for the world of work.

    “I trust it has been an exciting journey for you. And as you reach this destination… you join the nearly 200-year history of graduates from King’s College London who have been defined and distinguished by using their knowledge with purpose to make this world a better place,” the Vice-Chancellor and President Prof Shitij Kapur, said in his address.

    He welcomed the new graduates to “our global community of more than 220,000 alumni across 190 countries in this World.”

    “It is a community made up of Nobel laureates like the late Archbishop Desmond Tutu, Olympians like Dina Asher-Smith, distinguished scientists like Prof. Nancy Rothwell, and hundreds of other pioneers in their own right who will inspire you as you explore and thrive in the world beyond King’s,” the vice-chancellor affirmed.

    In his vote of thanks, the Chairman of the University Council, Rt. Hon. Lord Geidt congratulated the graduates, saying he looked forward “to meeting many more of those whose lives and careers have been influenced by their education and experiences at this great university.”

    As one of England’s top-ranked public universities, King’s College boasts an almost 200-year history, and has an estimated 27,000 students, with staff and student population from about 200 countries.

    Established by the Royal Charter in 1829 under the patronage of King George IV and the Duke of Wellington, King’s became one of the two founding colleges of the University of London, which was set up in 1836.

    Abidjan: The streets of Cote d’Ivoire’s commercial capital Abidjan was agog on Wednesday, as fans discuss and anticipate the epic clash between the Super Eagles of Nigeria and hosts Cote d’Ivoire on Thursday.

    The match is the second for both teams in Group A of the on-going 2023 AFCON.

    The News Agency of Nigeria (NAN) reports that Ivorian fans draped in their orange-white-and-green flags were seen dancing, while joints blare music and big screens dot all corners of the city.

    “We are ready for the match (tomorrow) against Nigeria, this is going to be a very interesting match because both countries are super powers in African football.

    “I am confident we will beat Nigeria tomorrow, ” Yao Kouassi who owns a bar in the city told NAN.

    Aminata Kouadio who owns a restaurant close to the Alassane Ouattara Stadium, said business has been good since the start of the tournament.
    She expressed confidence in the ability of the Elephants to trample on the Super Eagles on Thursday.

    “Our team will trample on your Eagles tomorrow,” she said in a smattering of English.
    Some Nigerians resident in the city also said the Super Eagles had all it takes to defeat Cote d’Ivoire, only if they up their game.

    Emmanuel Okafor, a business man resident in the city said the Nigerian community will be going to the stadium to support the Super Eagles, in spite of the economic crunch.

    “I have been living here for more than six years, so I know the city very well, it is always like this when there is a major football match.
    “So I want to appeal to our players to do us proud tomorrow.

    We’ll be going to the stadium to support them all the way,”he said.

    Certificate forgery: House of Reps member, Rita Orji has a case to answer – Court

    A High Court sitting in Apo Abuja has ruled that a former House of Representatives member, Rita Orji has a case to answer in the investigation of her WAEC certificate by the police.

    Delivering judgement on Monday, Justice Kawu Bello ruled that the Nigeria Police is empowered to investigate any petition brought before them according to section 200 of the constitution.

    The judge dismissed the matter and ordered Rita Orji to make herself available to the police for investigation.

    A former House of Representatives member, Rita Orji is currently in a legal battle with the police over a petition written against her to the Force Headquarters.

    The petition alleged that Ms Orji who was in the lower Chambers from 2015 to 2019 and also contested for same office in the last election possessed a fake WAEC result.
    The police had invited her for interrogation but she turned down the invitation and approached the High Court.

    Ms Orji in the suit prayed the court to restrain the police from investigating her and also maintain her fundamental human rights.

     

    Rita Orji represented Ajeromi-Ifelodun constituency in 2015 at the National Assembly on the platform of Peoples Democratic Party.
